Vt. Judge: Birth Mom Must Give Child To Ex-Partner

MONTPELIER, Vt. -- The birth mother of a 7-year-old Virginia girl must transfer custody of the child to the woman's former lesbian partner, a Vermont judge has ruled.
Vermont Family Court Judge William Cohen ordered Lisa Miller of Winchester, Va., to turn over daughter Isabella to Janet Jenkins of Fair Haven at 1 p.m. Friday at the Virginia home of Jenkins' parents.
Miller and Jenkins were joined in a Vermont civil union in 2000. Isabella was born to Miller through artificial insemination in 2002. The couple broke up in 2003, and Miller moved to Virginia, renounced homosexuality and became an evangelical Christian.
In the Dec. 22 order denying Miller's request to delay the transfer of Isabella, Cohen wrote: "It appears that Ms. Miller has ceased contact with her attorneys and disappeared with the minor child."
Liberty Counsel attorneys who have represented Miller in the past did not immediately respond to telephone messages left Tuesday by The Associated Press.
A listing for Lisa Miller in Winchester, Va., says the phone line has been temporarily disconnected at the customer's request.

Exactly. That's what has led society to eventually accept "same-sex" marriage and to cases like this one.
First, there were age-old laws on the books recognizing the husband as the legal father of any child born to the woman married to him. (That's why there was at least one case of a man ordered to pay child support for a child his ex-wife conceived through an adulterous affair.)
Then, heterosexual couples started using donors and surrogates. The names of the husband and wife (not the donor or surrogate) are put onto the birth certificate. That's why courts have ruled that "same-sex" couples can have both their names on the birth certificates.
And, so now here's this case. Probably, there will be many more to follow.

If there is proof of this, then the custodial parent should present it to the judge. She should also file a formal complaint with the local police.
This lady decided it was a great idea to enter into this relationship. She was participating in lesbian activity in the presence of the child at one point. It’s a little tough to come before the court and complain that what you were doing, is now taking place in the home with you not there, so the child should be removed.
Look, this type of activity takes place between heterosexuals too. They do things when together that they complain about later on, like it’s going to make a big difference.

If the seven year old can tell what is happening to child protective services, then the court will evaluate and take appropriate measures.
Absent that, it becomes a she said / she said situation, something terribly difficult for the judge to rule on.
As for one state honoring a civil ceremony in a neighboring state, isn’t that the right the lesbians were seeking everybody to honor at one point? So now they are, and Miller is unhappy about it? Too late.
Look, when Miller signed on to the lesbian civil union with Jenkins, then brought a child into the relationship, the groundwork was laid for this to become a nightmare.
I am very sorry it turned into one, but you and I both could have predicted his. And nobody would have listened if we had.

So, you can provide a source that shows that Ms. Miller is that actual biolofical mother while Ms. Jenkins had nothing to do with the biological make-up if the child?
Your cynical comments, especially where a 7 yr old is being forced to live with a fanatical lesbian who forces the girl to bathe naked with her, and hates Christianity now that Miller is now a Christian is disturbing.
Thanks for the additional information. It's always easier to put the puzzle together, when you have all the pieces. I concur with your assessment entirely. She has made the bed she is now being ordered to sleep in. The child loses in the end, but the biological mother can only blame herself.
Whatever - you can ascribe anything you like to me. It means nothing. I laugh at these women - that doesn’t mean I laugh about what the child is dealing with (whatever that is as no one’s yet showed that the child has actually been harmed).
It's in the original article. The information is also freely available in many other places. It was Lisa Miller's egg and an anonymous donor's sperm. Ms. Jenkins has absolutely no relationship to the child.
She has presented all these facts to both the Vermont court & the Virginia court. The Vermont court ruled against her, the Virginia court ruled in favor of her, then the Vermont Supreme Court AND the Virginia Supreme Court ruled that the Vermont court decision would take precedence over all the courts. This is a complete tavesty. Evil is called good and good is called evil. I hope these homo/lesbian loving judges will roast in hell throughout eternity for destroying this 7 year old girl.

And that being the case, Ms. Miller had better comply with the court order or get an injunction or she will be facing a contempt of court and or a kidnapping charge.
And a really doubt any court would grant custody or visitation to a mother who happens to be doing 20 years in prison.
