9/11 plotters start on their road to freedom (Lawyers to argue they're incompetent to stand trial)

The glorious fruit of giving the 9/11 plotters civilian trials is already beginning to appear. Watch for these guys to walk—after wasting a few taxpayer millions, that is. “Mental State Cited in 9/11 Case,” by Jess Bravin in the Wall Street Journal, November 27 (thanks to Elisa):

WASHINGTON—When five defendants are brought before a New York federal judge to face charges for the terror attacks of Sept. 11, 2001, the first question may be whether some of them are competent to stand trial at all.

Military lawyers for Ramzi Binalshibh, an accused organizer of the 9/11 plot, and Mustafa al-Hawsawi, the conspiracy’s alleged paymaster, say their clients have mental disorders that make them unfit for trial, likely caused or exacerbated by years of harsh confinement in Central Intelligence Agency custody.

The issue already has arisen in military-commission proceedings at the military's detention facility at Guantanamo Bay, Cuba. According to an August ruling by a military judge, prosecutors have made an "apparent concession" that Mr. Binalshibh "suffers from a delusional disorder-persecutory type" disorder. Mr. Binalshibh has been prescribed "a variety of psychotropic medications used to treat schizophrenia and/or bipolar disorder, including Haldol, Abilify, risperidone and Ativan," according to commission records.

In October 2008, a military medical board reported Mr. Binalshibh may suffer from "severe mental disease" that could "impair his ability to conduct or cooperate intelligently in his defense."...

Question: Can this be stopped? Any talk of suing AG Holder for example?

This is just so wrong...what’s the recourse when the highest law enforcement offical in the country is off his rocker?

A hint: it isn't the ballot box.

America -- a great idea, didn't last.

There was no point in trying these guys in civilian court if there wasn’t a chance that they’d be acquitted.

They will.

And a whole bunch of good guys are gonna take a fall over this.

I think you'd have to go back to the Kennedy administration to find out what to do with an AG that is off the reservation. But that is historical precedent. I advocate no particular response. Just saying...

Hmmm. I wonder what story Holder will come up with if they are found not guilty?

I hear ya.

And here I thought Janet Reno set a floor below which no future AG could sink...

We all thought it couldn’t sink further than Clinton presidency, but look we got fooled. I would take Clinton and Reno in a heart beat now.
I have never in my life seen anything like this.

The good news is these pukes are also "wanted" in Virginia for capital crimes, and we are getting a brand new Republican Governor, Republican Lt. Governor and Republican AG.

Obama may think he can just let them loose, but if he tries it he'll go on the list as a co-conspirator and end up in our courts.

Even the most Leftwingtard parts of this state tend to condemn mad dog killers to the gurneys!

Last I heard, Shakes is still living in a doublewide in Florida with her girlfriend.

The depth of depravity is unplumbed. Clinton appointee or not.

What is needed is a housecleaning. We'll get it, sooner, or later. Whether we want it or not.

"Hmmm. I wonder what story Holder will come up with if they are found not guilty?"

Thats an easy question to answer...Bush, Cheney, Haliburton, Blackwater, CIA, Abu-Grab. It was all their fault.

In all honestly this is who is being put on trial not the dirt bag muzzies who should have been capped as soon as they had no more intel that was usable.

Even with that kind of problem, Mr. Binalshibh could still qualify for vice president.

I may get flamed for this, but here goes:

Personally, at this point I *hope* that KSM & the other terrorists walk free on some technicality. This whole affair has degenerated into a complete farce, and failure to convict would hang like a dead stinking albatross around Obi wan Nairobi’s neck. There is no hope for real justice for the victims of 9/11 or their families at this point, and failure to convict might be exactly the sort of epic fail that would ensure a 1-term presidency for this clown, which itself may be a matter of life and death for Americans and America down the road.

It is also the begnning of a multi million dollar lawsuit against the US govt’s CIA. These a,,wipes will become scott-free wards of the American taxpayer.

Just like many others that will be putting the US on trial.

The losses to America will be multifold, losses in security, good men getting blamed, CIA/military getting demoralized, financial repercussions, then the greatest propaganda show for the obama muslims... with more opportunities for terrorism.

its endless what this bad decision means

At the end of the day, America will end up apologizing to the muslim world for its last fourteen hundred years of bad islamic policy.

Or better yet ,for being a part of a policy that has suppressed aggressive Islamic Imperialism over the last fourteen hundred years.

Heck, lets go bigger... only the Us of A has stood in the way of a caliphate, but now that Barrack is in office, it is no problem as the apologies will flow. He will write them checks to make their objectives real....

If they are found innocent I say turn them loose
on the steps of the courthouse , see if they can make it
to the UN for sanctuary.

Defendants who are declared incompetent aren’t turned out onto the streets. It’s not an acquittal. They’re held in mental hospitals until they’re “cured” — and once “cured,” they’re eligible to stand trial.

I say let this strategy play out. Instead of presenting themselves as martyrs for their glorious jihad, let them tell the world that they’re babbling basket cases. Not exactly the recruiting poster Al Qaeda wants.
