Gates could proclaim that he has located his testicles and say that KSM is his responsibility and Holder can’t have him. 0bama decides to side with Gates. Holder resigns. This would go to the Supreme Court, expedited, with the proper lawsuit being brought up in the correct circuit. A legal challenge would require a response from the President as to jurisdiction to transfer legal authority under the Executive Branch.

This is another Constitutional challenge within the Judiciary. No surprise the media has not raised it— not with the circus they assume they will cover in NYC. How about “no cameras in the courtroom” in NYC.... THAT would get their attention.

There is another alternative. Congress can withdraw the funding for trying these terrorists in ordinary criminal trials. I don't have much belief that the House and Senate would vote that way. On the other hand, bringing this idea to a vote in either House would put many Democrats between a rock and a hard place.

Do I vote against the President on this stupid decision? Or, do I vote against the people of my District who recognize that this is a foolish decision.
