Correct but it remains to be seen as to WHO (not the MSM for sure) will make an issue of this and hold both Dear Leader and Holder's feet to the fire until they admit that ONLY he has/had the authority to do so.
Can only hope that their is at least ONE Congress-critter who has a pair and make an issue of this as well as someone (unless O'Bozzo man's up) taking legal action against this action.

They know the trials will be the next OJ trial. Every news program will be focused on this issue to the exclusion of all other issues. The obamunists have plans to legalize the current criminal invaders and press on with cap and tax. The New york terror trials are wag the dog.
While we are focused on the terror trials we will be getting screwed - count on it.
I have no doubt of it...but it is a double whammy because as a people and a nation, the trials of these irregular, enemy combatants will also harm America while the marxist is using it as a smoke screen himself to do more.

Thanks for the heads up. I could not agree more. Have been arguing with the few people I know to the left of me who I still talk to about how terrible this decision is. The odd thing is most seem convinced when presented with the facts such as those in this posting. All is not lost, even the left-leaning can begin to see the truth.
The one thing I am quite sure of about this decision: the results will backfire, and they will backfire on Obama and Holder. Hopefully that won’t also include innocent people in New York or elsewhere.
The ‘best case’ I can imagine is a total circus with the defense trying like hell to get Cheney on the stand. I don’t think Americans are going to be particularly amused by the antics of the left and jihadi defense over this.
The ‘worst case’ would be some horrible jihadi hostage-and-klling spree, like Ft. Hood but in the vicinity of the trial. Obviously that would be a terrible, terrible Obama failure that is completely undeniable.
So eventually this bone is going to stick in his (and Holders) throats and they will choke on it.
Till then all we can do is keep our heads down, pray frequently and, as always, prepare for the worst.

Seems to me an ill wind is a blow'n. The only way the Justice Dept can be involved with the chain of custody, regarding EPOW or illegal combatants, is the CIC signing an executive order. Otherwise, the combatants stay in military custody, and are tried in a tribunal.
Eric Holder, who looks like Oprah's Steadman, has just made NYC a bigger target, propaganda platform, and circus side show that would make P T Barnum proud.
With this debacle of "health reform," in the Senate, 0bama dithering on a comprehensive strategy in Afghanistan, to his disastrous economic policies, and I could go on, we are in some deep Kimchee.
Best thing to do is get the affairs in order, eliminate the debt, get off the grid and go Galt.

As I write this at 1:26pst, tomorrow we will see an out of touch Congress pass the Senate health care fiasco. Then that and the House bill go to conference. They will massage it and buy off any dissenting politicians, and the bill will be passed (no matter how watered down) just to get the camels nose in the tent.
The Dims/libs believe that this time next year, all will be forgotten and they will be voted back in office. I fear they may be correct. And even if conservatives were to take back the House and the Senate (unlikely), then what? Obambi will still have the final say, and any socialist health care bill is solidified into the National paradigm. My suggestion...
STATES' RIGHTS is our last best hope.
Push the 10th Amendment to the US Constitution. Make that the issue of the day.
As has repeatedly been stated by more and more people, the enemy is lose in our own land. It is in the form of Government at all levels beginning with the present executive branch and rushing at the speed of light down to the lowest bureaucrat.
No one in their right mind, can look upon the actions of the present congress and NOT realize that the majority of those elected officials, are literally insane, with an evil lust for power that will not be stopped by the puny efforts of the sane folks remaining.
I frankly don’t care why they are the way they are, the unfortunate fall out being they mirror the same insanity of those that elected them to public office. There should not be one citizen of the Republic that now does not recognize who and what the real enemy is.
We are headed for a train wreck the likes of which we would not wish upon our worst enemy. Unfortunately, our worst enemy is mortally insistent on bringing disaster upon us faster than a speeding bullet, with economic, political, and social consequences of monumental proportions.
History is a great teacher, it is just unfortunate there are so few believers, until it is too late. Life based on true principles, and moral absolutes will always right the ship of state, but that usually isn’t good enough for those who would replace God’s law with man’s.

...and that rests in the hands of Governors with balls of brass, and state legislators with the same. Apologies in advance to the ballless, a gender issue that has less to do with the situation, than the mental toughness, indicated by the metaphor.
There have been hopeful signs recently that some of them will stand. I believe if five, as you say, did stand, that quite a few others very well could follow suite.
