Per Fox: Barbara Boxer has forced Crap and Tirade out of committee despite rule that at least two Republicans had to be present. No Repubs were there but she passed it anyway. Change you can believe in!
So what happens next? It sounds like well they just did it, so what?

I’ll say it once again; these Dems are willing to become political martyrs in return for making fundamental, irreversible changes to a free America. If they can ram through socialized medicine and a punishing global warming tax, redistribute as much wealth as possible to the unions, the nonproductive and their own pet causes as possible before the 2010 elections, they may be willing to be voted out with prejudice and hailed as left wing heroes for generations. If they can just screw everything up hopelessly right now, just screw it up so badly that no one can undo it, their kamikaze mission will be done. They know that they don’t have longer than another year.

They only needed a quorum for markup, not for voting it out of committee.

It seems Boxer cited a provision in the rules she claims allows her to proceed as long as a majority of committee members are present. Not that I dont trust her, although I most certainly do not, but I thought a quick trip over to the EPW rules site for a look-see was in order.
Now, according to Rule 2 of the committee rules: [my emphasis]
At committee business meetings, and for the purpose of approving the issuance of a subpoena or approving a committee resolution, one third of the members of the committee, at least two of whom are members of the minority party, constitute a quorum, except as provided in subsection (d).
And it appears to be the language of subsection (d) that Boxer is attempting to play games with:
No measure or matter may be reported to the Senate by the committee unless a majority of committee members cast votes in person.
From a laymans reading, one would surmise that although the bill can be reported out of committee with a simple majority, at least 2 Republicans need be present to consider any amendments. In which case, Boxers decision to continue markup sessions without minority representation would be as illegal as it is unprecedented.
Interestingly enough, Boxers deployment of the nuclear option, as many Republicans are referring to it, didnt seem to bother Sen. Lindsey Graham of South Carolina — the first Republican to endorse the bill. He and Senators Lieberman and Kerry just finished discussing the Bill before cameras, yet Graham said nothing about the Democrats impropriety. As it was, after all, his inexplicable turncoat actions that enabled Democrats and the MSM to stamp the now meaningless label bi-partisan on this disastrous legislation, surely something should have been said about this breach in EPW rules.
Prior to gaveling out for todays lunchtime recess, Boxer repeated numerous times that she intended to abide by the rules.
The question is: Whose rules those of the committee or those of the climate-hysterics currently controlling it?

I don't see how it can get past a court challenge.
I don't think Boxer is that stupid. Instead I think the dems have wakened and are trying to get rid of this disaster.
They're relying on the Repubs to quash it. They'll avoid the blame for the economic chaos resulting, earn credit for their efforts, and label the Republicans as enemies of the environment.
Pretty good strategy, at least the best anyone in their position could come up with. Will it work?
tossing them out next year won’t matter. the dems are playing ‘all-in’ and want their massive agendas passed while they have the power ... at all costs. they don’t care if they lose seats, they figure they’ll get them back
And even when its illegal - Timmy Geitner and more. Democrats don’t need to follow rules.
