The one thing Judge Carter did order last week was to make the dates final. Including the dates for a motion for summary judgment and the trial date.

I agree, although in his subsequent denial of Orly's request to lift the discovery stay, he said that the parties could move for extensions of time -- which would change the "final" dates.

If the Motion to dismiss is not granted, I'd think the case will be settled by summary judgment after discovery.

I agree that the case will probably be resolved on summary judgment motion if it goes forward.

What double standard? Bush, McLame, Ghore, Clintoon, and Biden voluntarily released certain records, such as their college transcripts and senior thesis; but, there is no LEGAL obligation that they produce anything other than what is required in the disclosure statement under federal and state law. The only double standard is the reaction of the press, but the law itself treats everyone equal. Even the Constitution is silent as to what a candidate for POTUS needs to do to prove that he or she is qualified to serve, which is why the issue is generally addressed at the state level when the candidate's name is placed upon the ballot.

If I, as a citizen of the United States, do not have standing or a right to know the answers to any of those questions, then this country is doomed and the constitution IS just a worthless piece of paper.

You have no "right" to know what a candidate has no legal obligation to provide, and there is nothing in the Constitution that gives you that right simply because you are a citizen.

I think people tried to get the issue addressed early but BHO stonewalled and courts did not force Obama to address the issue or show his long form birth certificate.

Slight correction. Perkins Coie did file two appellate briefs in the two Berg appeals from cases that were initiated in October and December 2008, before Obama was President.

However, except for those pre-inauguration cases, and the very few other cases filed pre-inauguration that named Obama as a defendant, the DOJ/Gov has defended against all eligibility cases (except, of course, where the courts have dismissed the case before the DOJ could enter an appearance).

You wanna bet? Watch and learn. The President of the United States has a LEGAL obligation to do as he pledged to do, preserve, protect and defend the constitution...

Now...if the President fails to do as he pledged to do, he has LEGALLY defaulted on his oath and as such, should be removed from office via impeachment at the very least. That is the closest thing to an actual legitimate question raised by the whole "Birther" circus.

Going back to original intent, it would seem that the Founders expected the electors to satisfy themselves that the candidate they were voting for was in fact eligible, and that the Congress would confirm the eligibility of the electoral vote recipients when the votes were counted before a joint session of Congress.
