The end of the Chicago handgun ban

The 2nd Amendment is about to arrive in Chicago--which is good news for citizens who see a need to have a handgun in the home for protection against the city's many criminals. It's bad news for Mayor Daley and other supporters of the existing ban on handguns, one of the most draconian in the nation. Chicago has long behaved as though gun owners don't have any rights. It is probably going to find out they do.

Last year, the Supreme Court struck down a similar Washington, D.C. ordinance banning handguns. "The Second Amendment," it found, "protects an individual's right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home." But Chicago insisted on keeping its law.

Odds are it will lose. Last year's ruling was limited to the District of Columbia, which is unique in being a federal enclave. The only question in this case is whether the 2nd Amendment applies to states and municipalities, as most other freedoms in the Bill of Rights now do.

Read the comments. It never ceases to amaze me the way in which liberals keep repeating the same old lies and disproven "studies" as though they were factual.

According to CDC data, more people are killed, in the USA by falls than by firearms.

--hopeful but not getting my hopes too high--recalling the great advice of the late Neal Knox, which was that you cannot predict what a court will do.

--there have been very good reasons in the past that the NRA, for example, has not pursued certain Second Amendment cases---

Every case that carries political or ideological overtones is a crapshoot. The judiciary has been thoroughly politicized and while there are certain to be judges who will do their best to rule according to existing law there are also judges who will rule according to political whim and social fad (and who paint conscientious judges into a corner by establishing insane precedents). And slowly but surely the rule of law erodes away because it is being flouted by far too many of the very people most entrusted to uphold it.

It would be nice. Chicago bans guns yet violence is prevalent. 39 states enacted the right to carry and saw violent crime rates drop.

We are talking about a right, right? Not some privilege granted from the government. So if it’s a right let’s carry on and stop playing games.

Rescind all gun laws now.

It's probably because the NRA knows how to count all the way to five.

Every single gun group from the NRA to the Second Amendment Sisters asked the Court during Heller to take the broad view so we didn't have to sue 20,000 times to get rid of 20,000 gun laws except one.

The do nothing goa was the only gun group to ask for a narrow view and that's why the NRA and the Illinois Rifle Association is suing.

The goa is sitting on the sidelines again as always.

That's an easy one. She already joined an opinion that mirrored what the 7th Circuit wrote about this very case. She's a carbon-copy of Breyer, although not remotely as erudite - in other words, she's RBG, but much younger and 40 lbs heavier.

Look at DC. Dc sort of recognizes the right to "keep" arms but not any right to "bear" arms."

It's not the whole ball game even if they don't. It would be nice to have it officially recognized that 2A rights, which Heller admitted apply to individuals, even do so in actual states and municipalities, for those living in places where such a ruling might matter.

Sotomayor has already joined in an appellate level decision that said the 2nd Amendment was not incorporated.

She talks about a wise Latina woman, she doesn't actually demonstrate that she is one.

Notice to all: This week on National Review Online - Uncommon Knowledge with Peter Robinson, Peter is interviewing Judge Laurence H. Silberman, who wrote the Appellate decision in District of Columbia v. Heller, and he comments on his decision.

I am ALREADY a LIFE MEMBER of the NRA, America’s oldest, and by FAR the largest, Civil Rights organization. I belong to several other, smaller gun rughts organizations, too.
