Mass. GOP seeks injunction on Kirk appointment

The Massachusetts Republican Party has filed an injunction in a Boston court seeking to block former Democratic Party chairman Paul Kirk from becoming the interim replacement for the late Sen. Edward Kennedy.

Lawmakers this week passed legislation giving Gov. Deval Patrick the power to appoint an interim replacement, but laws approved in Massachusetts usually take 90 days to go into effect. Patrick signed an emergency letter that he says allows the law to become effective immediately.

Republicans allege in their court filing that Patrick did not have the constitutional authority to do that.

But State Secretary William Galvin said today the power to make the immediate appointment is "very clearly available" to Patrick.

Kirk, the former head of the Democratic National Committee, is set to be sworn Friday.

I wish them well, but I don’t see it happening. All conservatives can do is try to help Scott Brown as quietly as possible (given the state’s toxic political culture).

There's really no way that Charlie Baker wins the Governor race, especially as long as now Independent Governor candidate Tim Cahill remains in the race. Unfortunately, I really don't see Governor Patrick not winning reelection, no matter how bad it gets in Massachusetts. The lifetime leftist voters REALLY ARE lifetime leftist voters.

Doesn’t the retirement package for a Senator essentially include his full salary plus platimum-plated benefits FOR LIFE???

How much would his combined (salary plus retirement) cost the taxpayers per month, if this guy only serves a total of four months?

It seems like an ex-post facto law to change this AFTER the death of Teddy. They should have passed it before the vacancy occurred. An injunction based on that fact seems very fair.

The prohibition on ex post facto laws only applies to criminal cases, not civil cases. It’s the same reason why we could have retroactive immunity for telecoms put into FISA.

Many ND people are socialist-inclined, going back to the days of their grandfathers and great-grandfathers’ Non-Partisan League activities. People in ND think government is solve problems if given the right commitment and funding. The churches there are liberal too.

And when that kind of split benefited the GOP, we got Rick Perry for another cycle. Won’t happen in 2010, as people in TX are outraged with Perry’s alleged inaction. I am beginning to think Hutchison will take the nomination. Half of the twenty Republican U.S. representatives from TX back Hutchison. People in TX think Hutchison can “do things”, rightly or wrongly.

The late Earl K. Long of Louisiana, political animal to the core, understood in particular how “wasted” votes in a primary can be finagled to benefit him. The people of LA never figured it out.
