DAYTON Police said Montgomery County prosecutors have approved aggravated robbery charges against a man who attempted to rob an elderly man at the point of an AK-47 assault rifle, only to be shot and wounded by his would-be victim.
Lt. Brian Johns said the suspect, Phillip D. Anderson, 24, is under armed guard at Miami Valley Hospital, where he is in stable condition.
Police said Anderson blocked the elderly mans vehicle with his own, then got out with the AK-47 and approached the man, who drew a handgun and shot Anderson twice. The incident occurred Saturday, Sept. 19, at West Third Street and Brooklyn Avenue.
The wounded suspect fled in his vehicle, which was later found outside 109 Brooklyn Ave. with the AK-47 inside, Johns said. Anderson was dropped off at Miami Valley Hospital by an unknown person, he said.
The robbery victim, who is in his 70s, is licensed to carry a concealed weapon, and his gun was registered, Johns said, adding he expects no charges to be filed against the man.

“Get off my lawn!”
The punk probably thought brandishing an AK would be enough.
The punk guessed wrong.

Don’t worry, since the prosecutors have only filed aggravated robbery charges we can safely assume that the perp’s AK was “properly registered” as well.

The way things are now in our society the 24-year-old will find an ACLU public defender who will counter-sue the elderly victim for a million dollars for defending himself too forcefully! In a sane culture this would be funny...BUT...
