James O'Keefe's foray into filmmaking may cost him a few years in the slammer.
O'Keefe and fellow conservative activist/budding investigative journalist Hannah Giles were the ones who dressed up like a pimp and a prostitute, respectively (or not), and went to the offices of the Association of Community Organizers for Reform Now (ACORN) in D.C. and Baltimore looking for advice on how to buy a house.
The resulting video caused quite a commotion and resulted in the firing of four ACORN employees, as well as other repercussions for those who support the organization.
In Maryland, it's against the law to tape a person without their prior permission. It's also illegal to "willfully use or willfully disclose the content of said audio," Baltimore City State Attorney Patricia Jessamy said in a statement released late Friday.
She added: "The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to five years."
The Baltimore City State Attorney's Office is investigating the matter.

If they did prosecute and get a conviction on this it would be appealed all the way to the Supreme Court on 1st Amendment grounds. The public has a right to know how Government funded organizations behave.

I cannot vouch for the accuracy of the article,whether or not there are Maryland cases interpreting the statue, or whether the statute has been amended since the article was written. But there are a number of legal wrinkles, such as, what is an intercept, what is an acquisition, etc., that make the legal issue unclear in this context (at least to me, a retired lawyer).
One question is: if the conversation was acquired by legal means (oral conversation in person) at the same time as it is recorded, is this is an illegal "intercept" under the statute? Perhaps the statute is to be interpreted as applying only when the intercepting act is illegal, such as a wiretap or bug, and not when there is a legally heard conversation (all parties present in person) that is also recorded at the same time.
At hospitals:
c. Force hospitals to concentrate on providing basic quality care instead of wasting huge sums on showcase buildings and technological gadgets.
At the health insurance companies:
a. Throw doctors and hospital administrators off the boards of directors, and replace them with a low- and moderate-income majority.
In the government:
5. Require the federal government to provide for the health care needs of recent immigrants.
Create a national health care system, along the following lines:
C. The system is controlled by democratically elected community-based committees.
E. Doctors are on set salaries.
F. Medical education is financed by the government, in exchange for which doctors are required to serve in the public health service for a period of at least ten years.

Sheesh, how stupid can things get? If they knew they were being filmed, they wouldn’t have proposed doing something illegal and it would be continuing today.
People do illegal things and then complain when they get caught as if it’s the fault of the person who exposed them.
Buy a clue: Don’t do anything illegal and you won’t have to worry about getting caught.

You can add for the record - black female mayor who is under indictment herself for illegal handling of money, and who has been on tv and radio defending the City (which is a total dependent on state tax funds) supporting ACORN with “housing authority” money.
i dount doubt that they will. They let Black Panthers get away with voter intimidation and fraud didn’t they?

They had video evidence and eye witness testimony ... they could have sent him to prison, but they dropped the charges.

Is there any law in Baltimore against aiding and abetting people who want to engage in child sex trafficking? ‘Cause, that’s exactly what the ACORN folks on the video were doing. The people who made the tape performed a public service. They should get an award, not jail time.
