Lucas Smith, the eBay seller who claims he has an authentic copy of Barack Obama's birth certificate issued in Kenya, flew in from the Dominican Republic to show up Tuesday in U.S. District Judge David Carter's courtroom in Santa Ana, Calif., to testify as a witness in a case challenging the president's eligibility.
Despite evidence that the Kenyan birth certificate touted by Smith may be a forgery, Taitz has decided to advance the document as part of her case to establish that Obama fails to meet the "natural born citizen" requirement specified in Section 1, Article Two of the U.S. Constitution as a qualification to serve as president of the United States.
At the hearing Tuesday, Judge Carter ruled Smith would have to testify at a later date in the proceedings, despite the protestations of plaintiffs' attorney Orly Taitz that Smith's life was in jeopardy.

Yes. It’s the same lawyer. Smith says that he went to Kenya and got the certificate.It is in his possession. Taitz only had a photo of the Bomford “copy” certificate. There are pics of both and they are different. What Smith says he has is a hospital issued copy of the the hospital certificate.
Smith is the loony freak that tried to sell a haunted house on ebay? Hes the one that wanted to meet the buyer on the steps of the capitol building in desmoine iowa?
Now Plains Radio says it is a possible false report, wishful thinking, cause the judge had scheduled a hearing in October for discovery.

That would be him. He may be on the level for once. He has filed papers with the court. There would be a price to pay fro lying.
Smith seems to have monies to travel. It is true that at the time he went to Kenya the cut price fares from Chicago to Nairobi, Kenya were only about $1850 round trip. Cedar Rapids is 206 miles from Chicago, Mombassa about 217 miles from Nairobi.
Now he is in the Dominican Republic. There is maybe someone's money behind this man.
Smith would be the dumbest person in the world to file this with the court, sign an affidavit because he knows O will screw him to the wall later.
Or he is an O-shill who has a free pass. I doubt the latter because any scam could backfire as Judge Carter and the court could get the HI long form BC and it would show O was not born in the USA.
Smith is sort of a semi-scammer. I think his angle is if he can pull this off and O gets the boot, someone is going to reward him and it may be handsomely. I would send him a donation.

i suppose if a copy (certified) of a HI BC is good enough, so should a copy (cert) of a kenyan BC. haha

It would be sealed, in Camera. The reasom would be to verify the authenticity of the document before making it part of the public record.
Now if the judge decides that the document filed is authentic, probabative, and admissable on its face as evidence which tends to prove or disprove the facts in issue, it will be made part of the public record when it is admitted as evidence at trial.
Remember, we are still in the pre-trial phase of this case, and to tell they truth, just about anything can happen, including the deaths of everyone involved on the plaintiffs side.
We are dealiing with a fascist movement which calls itself various names, the Obama Movement, the Obama Cabinet, the Obama Organization, Obots, whatever.The diehard Obama supporters would do anything to keep Obama in office.And I mean anything.Orly knows this very well.

Also one should not rule out the popssibility of witnesses planted by the Obamites, who come forward with what they know is a fake dead end document that could result in the case beinng dismissed.
Carter needs to order the release of the OBACOLB in Hawaii to his Court.Thats the direction in which Orly is heading.And if Obalawyers declare the Kenya BC fake, the judge is gonna say: " Produce the real one in Hawaii, in long form."

As Peter Libra pointed out, he sure does have money to travel.
Some intelligence agency could have hired him as a wacky freelancer because conservatives or someone out there had the goods. They need someone like Smith to get it out.
The more absurd the person - selling a kidney and haunted house on eBay - the better the cover. Undercover types are often oddballs and drifters. They drift around foreign countries, are single and usually nondescript. Instead of wearing Saville Row suits like Bond, they look like drifters. People might say they are losers. Watch Kevin Spacey as Virgil in The Usual Suspects.
He plays a gimp loser but it is all a cover. Yeah you have gung ho muscled ex-Marines operatives to fight but the deeper cover guys are nondescript drifter types. A very famous talk show host was up all night on a “special project” the night Smith had the BC on eBay and the price skyrocketed.
I think everyone in the govt in DC and people who are on inside like a few talk show hosts and a few others know he was born in Kenya. I think something is going on. There could be two big power structures battling. Evil and not so evil. Who knows.
What he has shown is not anything like the Colb.
