A federal hearing has been scheduled in the case of an Army captain seeking to avoid deployment based on arguments that President Barack Obama can’t legitimately hold office.
A hearing for Capt. Connie Rhodes is set for 2 p.m. Friday, court records show. Rhodes claims the president is “an illegal usurper” and “an unlawful pretender” and that she cannot lawfully act under his authority. Defendants include Obama, U.S. Defense Secretary Robert Gates and Col. Thomas MacDonald, Fort Benning garrison commander.
Rhodes seeks to stop Gates, MacDonald and others from giving her and others until Obama’s citizenship status is established, her complaint states. She also seeks conscientious objector status based on her doubts of Obama’s legitimacy.
It will be interesting to see if Orly uses this case as a precedent for her case scheduled in January should the court rule in the Captain’s favor tomorrow.
I just hope that one of these cases gets to Discovery.

If you are referring to all the Judges that refuse to hear these cases, I would agree with you.

I am not an attorney. I did serve in the Army, in Personell Management. Back then we had a bunch of COs that didn’t want to serve, or objected to Vietnam.
This case looks to be very poorly crafted.
If you say the orders are not legitimate, that is the case.
To then further effectively say: But even if the orders are legitimate, I object to war and don’t want to go.
Makes me think it is amateur hour on the legal front. Can’t they get some quality lawyers?
Do you think that Captain Rhodes will receive a new set of orders before 2 P.M. tomorrow?

Seems the Cpt’s superiors prevented her appearence today, though that account was denied by the DC appointed military attorney.
I hate these delays!
