BOSTON (AP) A cancer-stricken Sen. Edward M. Kennedy has written a poignant letter to Massachusetts leaders asking that they change state law to allow a speedy replacement of him in Congress.
The note to Gov. Deval Patrick and the state's Senate president and House speaker acknowledges the state changed its succession law in 2004 to require a special election to fill any vacancy. At the time, legislative Democrats were concerned Republican Gov. Mitt Romney would be able to fill any vacancy created as Sen. John Kerry ran for president.

I'm just getting to this thread now, so sorry if I post something already discussed. Yours is the first post I got to.
Resigning now won't speed up the process. It would probably freeze out the choice he's asking for, because the special election process would automatically begin, making it too late for the legislature to change it once it has started.
Kennedy doesn't want to give the people a chance to vote for a Republican -- he wants to ensure that the seat goes to a Democrat to preserve the 60-vote filibuster-proof Senate. In fact, with Kennedy immobilized, the Senate is not filibuster-proof now. Kennedy cannot vote absentee -- he must be present to vote.
He wants the legislature to change the law while he's still in the Senate, then he'll resign. Once he resigns, it's too late the change the rules regarding his replacement, as the Governor will be under pressure to set the date of the special election, if the law doesn't already specify it.

I think Mitt Romney ought to throw his name into the hat for the Senator’s seat in the special election. Kennedy is worried that the backlash on the healthcare will put a republican in his seat - WOW wouldn’t THAT be justice!
That would give Romney the leverage to rally support against the Democrats, declaring that they're trying to steal his opportunity to run for the seat from him, by changing the very law that they took from him in the first place.

It’s just too bad that MA voters weren’t smart enough to “replace” him a great many elections ago.
