SAN DIEGO Two people were shot early Thursday morning while they rode in a van loaded with suspected illegal immigrants that sped north across the U.S.-Mexico border in San Ysidro, U.S. Customs and Border Protection officials said.
U.S. authorities noticed the full-size van about 4:20 a.m. when they heard gunshots near the border. The van drove north into the United States from Mexico in the southbound lanes of Interstate 5, said Angelica De Cima, a Customs and Border Protection spokeswoman.
San Diego police said the van apparently was shot at by Mexican authorities before it crossed the border.
About 10 minutes later, the California Highway Patrol found the van, loaded with 42 people, stopped on state Route 905 at Picador Boulevard.
A man riding in the van was shot in the leg and a woman was shot in the foot, San Diego police said. They were taken to a hospital with injuries not considered life-threatening, De Cima said.
The 40 others crammed inside including two girls were detained and taken back to the port of entry to be processed by authorities.
De Cima said no U.S. authorities fired on the vehicle.

We are not set up to shoot at vans in the southbound lanes. If they had been in a northbound lane, and had run the border control station without stopping, they would have been shot at big time, plus those mats they throw out to puncture tires. And in San Ysidro, I think we also have helicopters.
Notice it’s never the American side shooting at them?
I’ll say it again: we need landmines.
Running up the southbound lane is SOP. Mostly we don’t chase them when they do that and they mostly get through.
Van and occupants instantly vapororize as they attempt to cross the border illegally.

I was a Customs Inspector at San Ysidro in the 80’s. I saw vehicles crammed with people, but never that many!
I also saw the Meican officials were more likely to fire their weapons than we were, and we never ever fired into Mexico!
One of my superiors explained “That would start the next Mexican-American War, and THAT is an incident report that I DON”T WANT TO WRITE!”
This is CBP-speak for "returned for expedited deportation after being fingerprinted, run through IAFIS to see if they're wanted for anything anywhere, photographed and having their bio-identifiers recorded." This means the next time they get caught here there is a reasonable chance they'll go to prison. The two injured ones did get free health care, but they will have a hold on them, as well, as in handcuffed to the bed. Had it not been noted that they had entered illegally, the outcome might have been as you outlined. But once it's on the record, they are definitively screwed. Hasta nunca.

Actually no, federal officers can not shoot at vehicles entering the country unless their lives are in immediate danger, period. If they did they would be prosecuted. They do use the spike strips which are effective if you can deploy them in time.
If someone tries to run a port of entry without stopping, the agents’ lives and the lives of others there are, by definition, in danger and you bet they can be shot at. It’s the law.
There have been countless incidents at the ports of entry where Mexican officials have opened fire on vehicles running the border only to shoot another Mexican officers. Spray and pray is their basic training method. If you see Mexican border cops with their weapons out seek immediate cover.
