Hawaii "Certification of Live Birth" - Date Accepted vs. Date Filed (Some clues)

On the Decosta COLB (which no one alleges is a fake,) every field header matches that of the Obama COLB except for one. On hers it says : Date ACCEPTED By State Registrar. On Obamas it says Date FILED By Registrar (Notice not the state registrar, this would be the local one ). Two different things. Either that field header is forged in Obamas ( they are from the same form - OHSM 1.1 Revised (11/01) ) or it means his registration was FILED at that date BUT was not ACCEPTED. If you look at the long form copy of the birth certificate available online from 1963, Field 20 says : Date Accepted by Local Registrar. Field 22 says Date Accepted by Registrar General ( which is the State Registrar ).A change from accepted to filed are significant enough linguistic changes that a different form would have to be created. Legally, accepted and filed are two very different things. So both these phrase were used on the form depending on the circumstances.

This section of the Hawaii Revised Stautes explains why that would be used:

Sec 338-16 ( late registration defined ) d) When an applicant does not submit the minimum documentation required by the rules for late registration or “when the state registrar finds reasons to question the validity or adequacy of the certificate or the documentary evidence, the state registrar shall not register the late certificate and shall advise the applicant of the reason for this action.”

So, something entered on the long form was not verifiable and thus, it was not approved by the state. So assuming his online COLB is not fake ( or the forgers were just too incompetent to notice they put in the wrong field header ), all you have with his online COLB is a FILING, not an ACCEPTED certificate

According to my research when I contacted a clerk the Hawaii Office of Vital Statistics in December (I'd like secondary confirmation of this in writing from Hawaii ...):

“DATE ACCEPTED BY STATE REGISTRAR” means the vital record was accepted as “official” document, signed by an official “certifier” who functions as a state-recognized witness of a birth, such as an M.D. or midwife. SEE DANAE'S LONG FORM BELOW.

“DATE FILED BY REGISTRAR”, most often means that the person may NOT have a state-recognized official “certifier” present at birth, but may have a person NON-state-recognized person present, such as an "informant". The baby may have been born at home, on a plane, in a taxi stuck in traffic, perhaps by a retired doctor, etc. The WND story calls this “Option BC2”, as discussed in the WND story on this, Guess how many ways to get Hawaii 'birth certificate'. A "Certificate of Late Birth" may get the "Date Accepted by Registrar" designation too, or "Option BC3" as reported in WND.

Also, as far as I can determine, these two types of acceptance by the state of Hawaii could represent two different levels of acceptance in court (regardless of what §338 might say; Hawaii Rules of Evidence, Chapter 626 trumps §338 in many areas).

For example, in a crime, if there's an independent witness of that crime, his/her testimony would stand up better than if it's just one person's account of the incident against another person.

In the case of a birth certificate, a state-recognized witness, such as a doctor, nurse or widwife is more credible than a mother by herself (Ann Dunham) in birth who could misremember the facts because of the pain of childbirth, medication, post-partum, etc. EVEN an un-certified witness ("informant"), such as a friend or grandmother (”Toots”), would be less-credible as a witness. It's like getting a witness of a notary event — it's far preferred that the witness has NO personal connection to the event.

“ACCEPTED” is witnessed and holds up better in court, because it is certified by a state-recognized witness.

“FILED” can be a “he said/she said” scenario and MORE easily be refuted, but is still “filed” by the (local) Register and “recognized” by the state of Hawaii.

More questions regarding the Y2K possibility: When did the state of Hawaii make the switch to electronic data storage and retrieval for making quick short form CoLBs? If the form was revised in 11/01, when was the previous form put into use and what did it look like and was it generated from electronic files? It makes sense that the state might have started a new form in November of 1999 with a 2001 dating, to assauge any confusion from computer generated retrievals.

Cook’s case was thrown out. His case against Simtech was thrown out. I sent it to LucyT last night. But it won’t do any good claiming a forgery. It doesn’t need to be. The fact is, a COLB only proves citizenship. UNLESS the original long form birth document states that you were born in the US, to US citizens, as Danae’s does, you are not natural born. And that is the beginning and end of it.

If that were true then Danae’s COLB should say “accepted by.”

It doesn’t, it says “filed by,” even though the underlying vital record on its face was signed by the registrar and “accepted” by the state.

So Danae’s COLB appears to be an anomoly under the distinction you are making.

With Danae’s Long Form COLB and MestaMachine’s pointing out that the time period was during the Y2k fix, with your research on the ‘File’ versus ‘Accepted’ data fields, it looks very much like a computer glitch caused the data field errors too subtle for a clerk to catch before it was mailed to her.

I was so floored. No, I was hurt. I took it personal and still do. Mostly because I am not lying, don’t have a forged document, and was just at my wits end.

I can’t explain this COLB. I only know that its legitimately from Hawaii Vital Statistics office. It was so unbelievable to me that these guys would say what they were saying. It still is, and it still hurts. I will get over it. I know what I know, which is that I am not wrong, and not in the wrong.

As for the document, the rightness or wrongness is solely the responsibility of the State. Because for damn sure this 40 yr old housewife didn’t conjure it out of thin air, and that in and of itself would be more likely than me being able to forge anything. Shoot I won’t even try to sign my husbands name for ANYTHING, and never have.

So needless to say it stung, all the more so because I didn’t do anything wrong other than to try and help out by offering the best I had to give, and giving up some of my anonymity in the process. Thats a LOT to ask anyone here and I volunteered it in the effort to help. That really stings.
