Editors Note: In December ‘08 a retired CIA officer commissioned an investigator to look into the Barack Obama birth certificate and eligibility issue. On July 21, 2009 westernjournalism.com obtained a copy of the investigator’s report. Here is an unedited version of the report.
The Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii
I think that I now understand the legal background to the question of where Obama was born.
Let’s begin with the statement that Dr. Chiyome Fukino, the Director of the Hawaii Department of Health released on October 31, 2008. The television and print media used this statement as a reason to prevent and treat with contempt any investigation into whether Barack Obama was not born in Hawaii. But the language of the statement was so carefully hedged and guarded that it should have had the opposite effect.
“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record. Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.”
It is understandable that after such an apparently definitive statement most news outlets, whether conservative or liberal, would accept this as sufficient grounds to relegate the controversy to the status of a fringe phenomenon. Unless they happened to take the trouble to look into the “state policies and procedures” as laid down by the relevant statutes. If they had done so, they would have seen that Dr. Fukino’s press release was carefully hedged and “lawyered” and practically worthless. But the media in general should not be faulted. The statement seems to roll out with such bureaucratic certainty and final authority. I believed it to be significant until a Honolulu attorney mailed me the relevant statutes. I was so surprised that I laughed out loud.

Well, then I don’t understand, not only in this piece but according to Orly Taitz, that Obama’s mother was considered a “minor” when she had Hussein? Unless women were considered “minors” in 1961 “if” they were under “21” ??? “
She was not considered a minor per say, just that she was unable to transfer citizenship to Obama since she did not live in the United States for 5 years after the age of 14 which was considered law at the time. She needed to be 19 and she was only 18 - 3 months shy of the 5 years required.
Congress has been changing laws left and right to qualify this man, but still all his records are disappearing at the speed of light.
His passport records have mysteriously been scrubbed and the 24 year old that was fingered for this crime shows up shot to death. Hmmm... One wonders what happened there?
Someone really needs to investigate all of these records that keep disappearing!

Passport records from 1981? Again, I’m no lawyer but my guess is that such a thing would not be a “presidential record.” It has nothing to do with his time as president.
Excellent point, but inapplicability does not stop a crook. He’ll make it fit by crookedness or force, or at least try.

It seems to me that reporters such as Greenfield were too fat and lazy to vet Obama. I think Greenfield wants his nose inside Obamas cheeks.
Their credibility is on the line, and they have no idea where in Hawaii Obama was supposedly born. None. No doctor, no town. Nothing.
They want this buried ASAP.
I find it absurd that there is no system in place in IL and other states and no where in the federal gov’t to check the eligibility of these people to even run for the POTUS!!!
You’ll notice he never says that he has personally seen and examined the document, only that he has seen that it is recorded in accordance with state policies and procedures (Clintonesque lawyerese to the max). I personally have no doubt that Barfsack Ocrumbo is an American hating Kenyan. The Kenyans have also “sealed” access to his birth certificate.
Apparently for Obama it's a very very complicated issue that must be guarded from view. I believe he became an Indonesian citizen and never lost that citizenship. I also believe he was born a Kenyan citizen, and can not opt out of it. He was born with it. To reporters, I issue this challenge. Prove me wrong. Prove me wrong and then laugh all you want. Until then STFU.

I can’t answer your question. When the birth occurred in 1961 I was about to start 11th grade and I didn’t consider myself an adult till I was 21. But I was in Canada and the rules may have been different here.

It’s been my view all along since this perpetrated Fraud has been going on for so long, that the COURTS need to intervene. This is the worst of all Constitutional crises that I can think of. The traitor and thug is fraudulently mowing down America and making life changing ORDERS with impunity. The thug is a blank slate.
American Courts or the American People must intervene NOW. I wonder how the Military really feels on this issue also??? I know they say nothing publically, but I keep wondering how they like carrying out this thugs rediculous and “dangerous to America’s Miltary” Orders? What a terrible but should have been, unnecessary situation!! CO
Stay tuned...there is a U.S. District Judge(a Marine) in Santa Ana, CA who has a case, Cook vs. Obama, before him now that the judge has already agreed to have a hearing regarding Obama’s Birth Certificate.
