Bombshell: Prominent Attorney Accuses Sotomayor of Possible Ethics Breach

The following letter was confirmed to me by Mr. Greenberg with the following statement:

"The letter was sent to Senators Sessions, Hatch, Grassley, Graham and Coburn. It was also sent to Cong. Peter King (R) NY. The story is being covered extensively by the photo blogs, the trade publications and the NY Times. No politician has responded. The NY Times quotes attributed to me are accurate and therefore I assume that the quotes of my adversary Mr. Fairhurst are accurate as well."

Text of the letter:

I am an attorney in NYC who represented White House Photographer Chris Usher in litigation against Corbis, a privately held company wholly owned by Bill Gates. The case principally concerned lost Presidential and campaign photography during the 2000 Bush v. Gore Campaign and the US Supreme Court case related thereto.We won at the trial level in the United States District Court for the Southern District of New York but the award to the victorious plaintiff was absurdly low.

We appealed to the 2nd Circuit Court of Appeals where the award was inexplicably upheld. The New York Times reported on this high profile case today, please see:

It was revealed therein by opposing counsel hat Judge Sotomayor and Mr. Gates’ counsel have known and (possibly worked with) each other for decades. Such relationship was never disclosed to me as plaintiff’s attorney by the Court. No opportunity for us to request that Judge Sotomayor recuse herself was afforded as this information was never disclosed.

The appearance of impropriety is astounding as Judge Sotomayor could have recused herself and we could have had another Appeals Panel within days.

Please contact me so that this apparently unethical judicial behavior is brought to the attention of the judiciary committee immediately.

Look , no one is going to take us seriously if we do all by the books. Wear red, white and blue, book rock bands, dinner and dancing. Sounds more like an ice cream social gathering than people who are worried that their freedom is leaving.

Might be wiser to book buses in cities, buy bread, lunch meat and chips, for a trip to DC to get mad.

Nice clothes, parties, rock bands, neatly printed signs and lack of anger gets NO attention. If people were really worried, they would not need to book reservations.

Truth is, many conservatives are not wealthy, they would go to DC but they cannot afford it which reinforces what the left think of us.

Take to the streets. Otherwise, accept the fate that Obama plans.

Oh it most certainly is ***when accompanied by a failure to disclose the relationship to opposing counsel***. It is clearly an ethical breach.

Disclosure of possible cozy relationships between a judge and opposing counsel are a minimum requirement of basic ethics. It doesn’t matter whether such judge ruled impartially, the nondisclosure will cast doubt on any decision rendered, in either way. Therefore, the relationship must be aired and counsel must be availed the opportunity to request recusal if not auto-initiated.

I saw plenty of anger among 1800 to attend the 7-4 Tea Party in Olympia, WA, to follow the 400 the week before, the 1200 in Seattle on 4-15, the 5,000 in Oly on 4-15...the counter protest the like Seattle had never seen on 5-31 to Obamacare...etc. There was anger and spirit and it was a great protest on 5-31..

We’ve got a contact list out here of quick deployment that can moblize several hundred for any kind of protest or counter protest needed, and that list is growing...we’re seeing conservative activism on the DEEP blue west side of this state that is welling up and growing out of ANGER.

Trust me, it is not business, nor politics as usual here, or anywhere in this nation right now.

Yes, thanks for taking a shot at the question...I’m not saying we’ve got it all worked out, what I am saying is that it’s a start and we shouldn’t despise that. Give it a little bit of time to grow and build, it’s building in ways we’ve never seen before...

But obviously this isn’t about Mr. Greenberg.

As has been explained in the thread already, if the "relationship" is merely knowing a person for many years, or having worked in the same office or firm some years ago, then no, disclosure is not necessary.

Disclosure of possible cozy relationships between a judge and opposing counsel are a minimum requirement of basic ethics.

You're assuming facts not in evidence, counselor. The extent of the "relationship" that has been alleged amounts to having served on the same committee several decades ago. That's not the sort of thing that judges are ethically bound to disclose. Period.

I just want to emphasize the fact that people are needed from all walks of life. There are many right here on this forum that are hurting financially right now, ot maybe they have never had much money. They would love to participate because they love their freedom even if they don’t have bucks.

It can be done and should be done.
