Court Upholds Dismissal of Colorado Professor

DENVER — Three months after a jury ruled that Ward L. Churchill, a former University of Colorado professor, was wrongfully terminated for his political views, a judge on Tuesday refused to give him his job back.

The judge, Larry J. Naves of Denver District Court, ruled that the university’s regents were immune to liability in this case because they were acting as judicial officers when they voted to dismiss Mr. Churchill after a faculty committee concluded that he had committed academic fraud.

Mr. Churchill, an ethnic studies professor, caused a national uproar when he referred in an essay to some victims of the Sept. 11 terrorist attacks as “little Eichmanns,” and he was terminated in 2007.

He filed a wrongful-termination suit earlier this year, and after a monthlong trial, a jury found that his political views played a substantial role in his dismissal. But the jury awarded Mr. Churchill only $1 in damages.

The headline is not correct. The court took back the award. The jury awarded him $1 but the ruling today rescinded the verdict and award.

Wait a second, how can his lawyer appeal if he won? In fact, isn’t that the 1$ settlements are for, so he can never appeal the case? (this has happened before, I suspect there’s even a euphemism for it)

Want to know why Johnny and Susie can barely read and are otherwise useless human beings with no marketable job skills, even though they've got a four year degree? It's because we're wasting money on bogus courses like ethnic studies.

Plus interest. The case is a few years old so interest accumulates.

Incorrect. The jury reached their verdict on 2 April 2009 and said verdict has been set aside with today's ruling by Judge Naves. The phony Indian and his shyster can appeal but it is highly unlikely that the Chief Judge in Denver District Court will be overturned.

The real problem is that he got hired in the first place.

His comments about 9/11, while loathsome, are protected free speech. The thing is though that he lied, a lot, about his qualifications, and his plagiarism was so blatant it should have been caught during the hiring process.

That it wasn’t means there was distinct Leftist bias. I have to say that the investigation was the result of distinct bias the other way. They went looking for something minor they could use against him. And found out to their shock that he was a complete and utter fraud.

The $1 in damages was excessive. I would have awarded him a photocopy of a $3 bill executed in crayon. That would be appropriate.

You are correct. It seems the jury was VERY wise.

However, (see post #5), the judge tossed the jury's verdict and overturned the award. Seems the judge thought the bogus Indian's charges were bogus too, and the jury didn't have to nullify an appeal or refiling after all.
