Attorney attacks charges against UT student in Palin e-mail case

KNOXVILLE - A defense attorney for a University of Tennessee student accused of accessing Alaska Gov. Sarah Palin's e-mail account is asking a judge today to toss out the case.

It was deliberate and malicious towards a Governor and a Real Vice presidential candidate He needs serious prison time.

Great post from a reader in response;

I know there will be a some hateful anti-Palin spitting on this one, but the bottom line is.... this kid intentionally and without permission, hacked into someone else’s private communications. (Not to mention the victim is a government official). He KNEW it was illegal.

The FACT is that he did it with ONE SINGULAR GOAL - to find dirt on Palin and influence a FEDERAL ELECTION. If you deny a POLITICAL MOTIVE in this, I would have a hard time giving you ANY credibility.

This is really serious stuff, and he should be punished to THE SAME SENTENCE as some Republican that hacked into AND FORWARDED Obama’s private e-mail. (We all know that if anyone did that to Obama, they would be absolutely crucified - ESPECIALLY during an election).

(for the inevitable “blame-Palin” crowd) - Blaming Palin for using simple passwords is EXACTLY the same as blaming a woman for getting raped because she wore a mini-skirt. In both cases, the victims were violated, without permission and against their will, by someone KNOWING what they were doing was illegal.

The new indictment charges that Kernell used at least one proxy server “to conceal his true Internet Protocol address and location while he exercised control over the e-mail account.” A proxy server allows an Internet user to make a remote connection and use it as a “pass through” point to other places on the Internet, masking the identity of the original computer and assuming the properties and Internet Protocol address of the proxy server.

The obstruction of justice charge stems from the indictment’s allegation that Kernell “removed, altered, concealed and covered up records and files on his laptop computer concerning his involvement in the scheme.”

The original indictment was unsealed in the highly charged atmosphere of a presidential campaign with Palin on the GOP ticket and Kernell the son of a longtime Democratic state legislator. But Rep. Kernell repeatedly denied there was any political involvement, while he supported his son.

IF any of your kids did this, the case would have been prosecuted by the State of Tennessee and not the Feds and he/she would have received judicial diversion and had their record cleared in a year.

The ONLY reason this kid is facing Federal felony charges is b/c Rush-loving dittoheads are out there crying like this is the crime of the century and the current Justice Department hasn’t sent enough of the right-wingnuts hired as career employees under Bush back to the private sector.

The Memphis paper did a much better job than Knox News or the Tennessean(not that the Tennessean EVER does a good job on anything) on this, I am surprised.

prosecutors charged Kernell with identity theft, even though Davies maintains that a Yahoo! account such as the one used by Palin is not a legal means of identification.
"It is not a name," Davies argued. "I think you would go back to the traditional or plain meaning of what a name is. Gov.Palin@yahoo.com is not a name."

Wow, sounds like Clinton and his famous what "is" is.

He is at least 20 (according to article in Oct) & could be 21. Love how they say a college student...he was probably a junior—clearly he knew what he was doing.

That’s not neccesarily true. Since 9/11 the federal government has been agressively pursuing security breaches on internet based financial and communication platforms. Obama even installed a Computer Security Czar just to up the ante.

What this kid did was childish, yes, but also a blatant violation of recent Federal laws. And it could get even worse since the proxy, the email company, and even the Palin family can sue him in Federal court for what he did. This is the type of stupidity that prosecutors will make an example of.
