If you read Ruthie’s statement you will truly be dismayed.
She said the firefighters had no inherent right to a promotion.
It was a test for promotion. That seemed to escape her notice. And the other three joined her in that flawed logic.

...most minority firefighters are first generation firefighters and have no kin network over which study materials and assistance can be provided. They cite that, in conjunction with the reported multi-week backorder for study materials from the publisher, this legacy advantage afforded to white second+ generation firefighters is partly responsible for the disparity in racial performance. And of course, the city of New Haven is better served by first-generation firefighters with no access to networks and advice than by persons raised to the purple -- in families with a willingness to die for their fellow man. Or woman. Or transgender.
Next, the civil rights industry will sue to have the children of parents with high IQs graded on a negative curve in school -- "handicapping" will deduct a grade for every 10 points of parental IQ above the lowest parental score in the commoonity. /sarc

Good! I’ve always had a problem with the dichotomy between “America the Diverse Melting Pot” and “America the Home of Minority Entitlement.”
I’ve done pretty good for myself and never once did I have to rely on the fact that my great-grandparents came here from a Latin American country, giving me a beneficial last name, to get a bump-up over other people. Hell, I don’t even speak Spanish - it just seems lazy to use it to my advantage.

The GOP better bring this up. However, Sotomayor will note that Hispanic firefighters were also put at a disadvantage.It would be nice if Hispanic race hustlers would note that Sorosmayor put Hispanic firefighters at a disadvantage.

Their argument can be summed up as follows: performance disparity should never fall along racial lines, and if it does, it is clear evidence of a racially discriminatory performance measure.So if a professional basketball team is majority black, the selection process is discriminatory? hmm...
