Woman called 'poster child' for need to reform drunken driving laws

Waukesha -- A woman accused of four drunken driving offenses in three weeks is a "poster child" for the need to reform Wisconsin's drunken driving laws.

That's what Waukesha County Court Commission Martin Binn said Friday as the Milwaukee woman, 27-year-old Nicole M. Bailey, appeared before him Friday.

Bailey had a new charge filed Friday in Waukesha County Circuit Court in connection with a June 13 traffic stop in Menomonee Falls by an officer who was investigating a hit-and-run accident, according to the criminal complaint.

Bailey wasn’t driving the 1999 BMW at the time of the accident, but she was driving it when the investigating officer saw the vehicle turn from North Point Drive into a condominium complex and park, according to Menomonee Falls police and the criminal complaint.

The BMW had struck a decorative rock and small fence in a parking lot.

Bailey told the officer that she took over driving the vehicle because the owner was too intoxicated, the complaint says.

The officer questioned Bailey, determined her driver’s license had been revoked and gave her a preliminary breath test. She registered a 0.07, under the legal limit of 0.08.

Bailey, according to court records, had been convicted May 26 in Milwaukee County of first-offense drunken driving stemming from an arrest on April 25. Her license was revoked in that case.

On Friday Binn chastised Bailey and said Wisconsin’s operating while intoxicated laws need to be changed so they are more strict.

In Wisconsin, drunken driving isn’t a felony until the fifth offense, and first offenses are non-criminal municipal citations.

“If ever anyone was a poster child for the need to change our drunk driving rules and penalties for repeat, repeat, repeat OWIs, Ms. Bailey fits the bill,” he said.

“She continues to drink and drive and put everyone at risk,” Binn said.

At the time of her arrest in Milwaukee, Bailey had two pending drunken-driving cases stemming from arrests in Menomonee Falls, on April 18 and April 20.

She was arrested a third time in Menomonee Falls on May 8, shortly after dropping her children off at school. A sample showed her alcohol level at 0.17, the complaint says.

She was charged Tuesday in Waukesha Circuit Court in connection with the Menomonee Falls arrests.

At the time, Binn said that in his experience “the defendant set a new record of being arrested four times in 20 days” for OWI.

Bailey is being held on $25,500 bail in connection with the cases and is scheduled for a preliminary hearing on July 2.

What caught my eye about THIS one, though not stated in the article, is many of the arrests were made during daylight hours.

Doesn’t look that bad in prison orange . . .

Says something about the nature of flesh vs the imposition of natural law and reason.

Yes, we need a lot more felonies on the books and a lot more people doing hard time for drunk driving. We have plenty of space in jails so let’s pack ‘em in.
