Emergency filing: Chrysler creditors take Obama to Supreme Court
DC Republican Examiner ^ | 6/7/09 | Bill Dupray

Posted on 06/07/2009 7:49:10 AM PDT by anniegetyourgun

This is nothing short of Americans asking the Judiciary Branch to step in and exercise its check and balance powers to stop an out-of-control Executive Branch. Our Republic is held together by such power, and in this instance, the Supreme Court is the last bulwark against an authoritarian president nationalizing a private company and extinguishing Constitutionally protected contract and property rights to reach his goal of giving the company to his political allies.

From the article:
Thankfully, there are brave Americans who are willing to take on an dangerously left-wing White House, despite the very real prospect that whether they win or lose, they will be punished in some way for their insolence. Authoritarians are not a forgiving bunch.

Excellent news. The Kenyan will be outraged that anyone would attempt to slow his socialist juggernaut.

I’m sure the people making the filing don’t meet the empathy standard.

This is part of why Obama wants his SCOTUS nominee right away. She will further his expansion of exec branch powers agenda.

The filing is by Indiana teachers and police retirement funds. No empathy from The Kenyan for teachers and police. Only to muslim terrorists and their benefactors.

“The Kenyan will be outraged that anyone would attempt to slow his socialist juggernaut.”

But, slow it we must, if we are to hold on to our freedoms, our rights and our country.

This man is dangerous to the future of the nation.

I’ve had a hard time with the whole empathy thing. I can understand empathy, as empathy is nothing more than being able to put yourself in someone else’s shoes, but its not empathy he wants for these people. Its sympathy. He wants judges that can put themselves in another person’s shoes and judge on the side of sympathy.

Yes, glad to see it. However, there is no justice in the land anymore.

There's only one problem with this, and it can be summed up in three little words:

Ruth Bader Ginsberg

(I believe I read that she is the one who will be receiving the emergency appeal.)

From the filing:
“The company is effectively the same, only the secured creditors have been eliminated from the capital structure, and the unsecured creditors have been elevated.”

The word “sham” appears in the filing. There may have been a close debate over using the word “fraud”(by the Treasury).

It will never get to court. A "special investor class" will be formed to give full payment to union retirement funds, other "greedy investors" will just have to make do with further cuts in their "fair share".

This is the first useful thing I’ve seen from a teacher’s union in a very long time. Maybe they will want to retire someday.
