Michelle Obama steps into SCOTUS debate

First lady Michelle Obama used her commencement address to a local charter school to take on critics of Judge Sonia Sotomayor, placing herself squarely in the debate over the nominee to the Supreme Court.

Obama compared her own experiences to those of Sotomayor, recalling the "voices of people sowing seeds of doubt" who questioned whether she and people with similar backgrounds were ready.

"Judge Sotomayor is more than ready. I was more than ready, and Barack Obama is certainly more than ready,” Obama said.

Obama likened the feeling she had as a high school graduate with Princeton in her future to Sotomayor's experience attending Princeton, as well.

"When she arrived as a freshman, she said she felt like a visitor landing in a foreign county," Obama said. "She was too embarrassed to ask questions."

Sotomayor’s Latina woman comment, which was later published in a law review article, can be criticized on a conceptual basis. Sotomayor’s comment indicates that she does not distinguish between the category of (a) relationships between intimates and (b) relationships between rights-bearing individuals.

Relationships between intimates involve a form of social recognition that includes empathy, care, and compassion. These are all qualities relevant in our relationships with family and friends.

In contrast, relationships between rights-bearing individuals involve respect, a concept that is defined in several ways in the legal world. These ways include defamation law, libel law, civil rights law, even corporate and condominium law where respect manifests itself as fiduciary duty (the duty to think in terms of the good of the whole business or condominium corporation, as opposed to one’s personal good).

I find it bizarre that two people trained in the law, Sotomayor and Obama, demonstrate so little understanding of the discipline they were trained in. Why aren’t law professors, lawyers, sociologists, etc., not picking up on the quite obvious category errors these two people are making? This is an obvious case where Sotomayor and Obama have demonstrated they are using incoherent conceptualizations about relationships between rights-bearing individuals. There is a philosophical and legal literature on the topic. Obviously Sotomayor and Obama didn’t read that literature, or didn’t understand it.

If she’s suggesting that:
we were wrong about her and her (quite possibly muslim, foreign-born) husband, who is apparently driving us all over the edge of a cliff,
so we’re wrong about the latina who is wiser than whitey ...

Objection—assumes facts not in evidence!

The biggest problem libs have with Sotomayor criticism is the fact that she's been called a racist - which is an accurate term no one has denied.

I haven't read/seen any criticism about her "being ready".

She urged them to, like Sotomayor, "challenge stereotypes and emerge as leaders."

Be nice if more people started challenging white stereotypes.

For what? Wearing designer clothing, planting carrots and going to broadway shows? You are where you are at the moment because of who you are married to, period. Many of us didn't vote for him and no one voted for you.

These Ivy League and other prestigious universities have completely stood higher education in the USA on its head for the sole purpose of achieving ‘diversity.’ Does anyone to this day believe Mrs. Obama would have been admitted without the boost of her minority status?

We can only hope (in vain) that the day comes when applicants don’t have to check off race/gender OR relatives who’ve graduated from the institution OR NCAA standing.

They insist on admitting less qualified students to make their diversity numbers look good .. regardless of the admittee’s readiness. The ‘legacy’ and athletics admitee process also admits students less than prepared for rigorous academics. It happens at the Ivies, at the military academies, at top ranked colleges across the country. And, God knows, it happens at the big sports schools.

It would be nice to think that there is at least one university in the USA that is a true meritocracy. Don’t think we’ll see that in any of our lifetimes.
