“When we first moved there, we didn’t realize the dirt pile across the street from us was a shooting berm,”

There should be gun ranges they can go to, our kids are in a 4H shooting program and we went to a farm for the actual shooting, but behind the birm which was only 10th tall was a housing addition, I was shocked they were allowing novices do training shooting with only that protecting those behind the wall, an accident waiting to happen.

In their court filings, Herrada and Valentine say they shoot in the direction of open fields and that their berms are large enough for recreational shooting.

These two will lose this, you have no legal right to fire a bullet onto your neighbors land.

Then in late 2002 the couple moved from Port Aransas to Live Oak County to be nearer their daughter and grandchildren. Herrada and Valentine already lived in the subdivision and had constructed their shooting berms in 1988 and 1996, respectively, according to the suit.

...And there, my friends is the money quote. Osbourne is a prime USDA-choice ***hole.

Looks like this will be stopped because of the deed restrictions.

Too bad they can’t shoot on their own property.

I wonder what these pieces of liberal human excrement do when a thunderstorm comes up? Do they try to get a law passed so that lightning does not strike in their yard?

Their neighbors are not shooting within a city limits, they are in the COUNTRY for crying out loud!

Just some more whiners wanting gun control, nothing more.

This is just city folks moving to the country because they can't take city life any longer. Then the first thing they do is try to change everything to make it just like it was in the city they moved from. This is BS!!!!!
I shoot on my property all the time. That's why I moved out here. The major selling point was that no houses will ever be built downrange. I so have neighbors across the street, they use my range when they want. I also have a new neighbor down the street who has reported me many times. It all worked out well. The neighbor is still pissed but the cops stop by to shoot now and then.
If these people do not like the country environment then they need to move back to the city and leave us country folks in peace.
This is anti gun paranoia. This is anti gun propaganda. This is total BS!!!!

Yep. Osborne is trying to prevent the other homeowners from enjoying their property, even though they built berms for safety. It’s the same as the fools who buy in a subdivision in the landing pattern of an airport and complain about the noise.

Both the Osborns say they are not against guns but what they call irresponsible gun use.

Okay, who gets to define 'Irresponsible' gun use?

This is not a constitutional issue to them.

Kind of like when someone says “it's not about the money, it's ABOUT the money”

Like it or not, this can be construed as an 2nd amendment issue

regularly practice shooting their guns, as often as once a week during competition training,

Once a week? These people are carrying on like this over something that may happen as often as once a week? If you miss this detail in the article it makes it sound like it’s a 24/7 thing when it’s not.

10 foot tall wall.

A stray shot with a high enough trajectory could sail over this wall and into the neighbor's house or yard. It's possible. Neighbors should not be placed at any risk from the shooting, however slight.

Lightning is a natural phenomenon, target shooting in one's yard is not.

I've heard that argument before, a couple of duds down the road were using their neighbors fence post as a target. All that argument got them was a permanent $10,000.00 restraining order.

I don't have all the facts on this particular case (neither does anybody else I've seen posting here). So I'll answer this one general question:

Okay, who gets to define 'Irresponsible' gun use?

(Part of) The answer is simple and should be obvious: When your bullets are landing on my property, your gun use is irresponsible.

Maybe they should pass an ordinance banning bath tubs, electricity, and leaving your home without a 2’ thick wrap of bubblewrap. After all, who knows what “could” happen...
