PITTSBURGH - U.S. Rep. John Murtha shouldn't be immune from a defamation lawsuit for saying Marines killed Iraqi women and children "in cold blood," because the lawmaker's comments came outside the scope of his official duties, a former Marine's attorney said.
The attorney, Noah Geary, on Wednesday filed an amended federal defamation lawsuit on behalf of Justin Sharratt, 24, a former lance corporal from Canonsburg. The new complaint, which adds 13 paragraphs to a lawsuit originally filed in September, was prompted by the dismissal of a similar suit against Murtha by Staff Sgt. Frank Wuterich.

I used to work with Justin’s mother and met the whole family many times while working there. They are some of the most decent people you’d ever meet. Murtha is truly evil.

OK, give me credit for my defense of the 99.99% of Marines who have served us so well, please?
The Marine who is bringing this suit to protect not only him, but his brother Marines, is certainly NOT an Ex-Marine.
The idea of an Ex-Marine is anathema to all right thinking Americans, and certainly all Marines who are just post service.
I would like to think I had the right idea here. When I see the term “Ex Marine” I bristle — part of my schooling here at FR.
I certainly give you credit.
A.A. Cunningham's meager list is proof that 99.99% of Marines will always be Marines, and I'm sure Cunningham would agree.
The problem is with the headline writers and journalists who are clueless to the meaning of the term "EX-Marine".
They don't get it, they have no clue that a cretin like Murtha is despised by Marines and is referred to by them as an "EX-Marine" as a way of cutting him out of the Corps and preserving the Corps' honor.
The same headline writers and journalists will never understand that a man like Justin Sharratt will always be a Marine, part of the eternal Corps that lives on with honor.

Thanks, amigo. I know what I have learned about the concept of an “ex marine” and now I bristle when I see it posted — like fingernails on a chalk board.
People don’t appreciate how much FR is a place of education.

It is legal, because it is constitutional. Yet, there are limitations.
They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.
It appears to me in reading the above, that they are not immune if they have committed treason, felony, or breach of the peace.
Next,it appears that for speech or debate IN EITHER HOUSE, they are immune from questioning.
They can't commit crimes and speech that deals with their duties is immune.
To me, the conclusion is inescapable. If Murtha is immune for his pre-trial conviction of the Haditha Marines as murderers, then his duties include the trials of US service members. If that is so, if these trials are his duty, then he MUST BE a source from which Unlawful Command Influence can flow.
If the trials of service members are NOT his duty, then he should be prosecutable for maligning these Vets.
They can't have it both ways. Murtha's comments are either illegal or they constitute meddling in the trials, unlawful command influence.
At least my hometown paper had enough sense to correct the headline!
