The right to bear arms is famously and specifically referenced in the Second Amendment to the U.S. Constitution. Alas, for advocates of the right, the language of the amendment gets tangled up in the regulating of militias and the interpretation of commas. Now a multistate movement is trying to find more robust constitutional support in another amendment, which makes no mention of weaponry at all. The 10th Amendment declares, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

Just as Rep. Brandon Creighton, R-Conroe, was introducing the House resolution when Rep. Senfronia Thompson, D-Houston, raised the procedural point that shot it down. She said that "states rights" was used as a banner for segregation and Jim Crow laws, but that was not her immediate concern. Thompson said she opposed the resolution because it, and others like it, are feeding movements that challenge federal authorities to regulate guns, taxes or fund needed state programs such as children's health and unemployment insurance. "I don't want to see that used as a mechanism to block that assistance," Thompson said.

On Tuesday, 05-26-09, Massachusetts State Representative Jeffrey Davis Perry (R-Sandwich) filed a Resolution before the House of Representatives to protect the Founding Fathers’ intent and the Constitutional protections of the 10th Amendment to the United States Constitution, which states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

On 05-26-09 Tennessee’s House of Representatives overwhelmingly passed House Joint Resolution 108 (HJR0108), which was introduced by Susan Lynn in February.  After adopting one amendment, the final version passed 85-2.The resolution urges Congress to recognize Tennessee’s sovereignty under the 10th Amendment, and is ready for transmittal to the State Senate.

Supporters say the resolution is a reminder to Congress in response to federal expansion. Today, the Tennessee State Senate approved Senate Bill 1610 (SB1610), the Tennesse Firearms Freedom Act, by a vote of 22-7. The House companion bill, HB1796 previously passed the House by a vote of 87-1.On its way to the Governor’s desk, the bill states that “federal laws and regulations do not apply to personal firearms, firearm accessories, or ammunition that is manufactured in Tennessee and remains in Tennessee.

Today, the Louisiana State House voted to approve Senate Concurrent Resolution 2 (SCR2) which “Memorializes Congress to affirm Louisiana’s sovereignty under the Tenth Amendment of the Constitution of the United States of America and to demand that the federal government halt its practices of assuming powers and imposing mandates upon the states for purposes not enumerated by the Constitution of the United States of America.” The resolution, authored by State Senator Crowe, passed by a vote of 59-12.  It previously passed the State Senate by a vote of 32-0.
