Court Blocks Release Of 17 Uighurs Into U.S.

A federal appeals court yesterday blocked the transfer to the United States of a small band of Chinese Muslims held at the U.S. military prison at Guantanamo Bay, Cuba.

The decision by a three-judge panel reversed a lower court ruling that ordered the government to release the 17 Uighurs and resettle them with Uighur families in the Washington region.

The government no longer considers the Uighurs to be enemy combatants and has been trying to find nations willing to take them in. U.S. authorities do not want to send the men home to China, where they are considered terrorists and may be tortured.

Attorney General Eric H. Holder Jr. is visiting the facility Monday. He is in charge of a government task force that will determine who can be released, sent to other countries or charged with crimes. President Obama has said he wants to close the prison within a year.

Only the executive branch and Congress have the power to allow people to enter the United States, they said.

Government lawyers have said that because the men trained at a military camp in Afghanistan they would probably be prevented from entering the United States under immigration laws.

A real quadruple insanity judicial activism and perversion of justice story.

A) The US government says they're not terrorists, but they can't be released back their home country of China because China says that they *are* terrorists and will prosecute them.

b) The first whacko judge wanted to "release the 17 Uighurs and resettle them with Uighur families in the Washington [presumably DC?] region." Great. 17 more Muslim terrorists in DC Metro, probably Northern VA. Just what we need.

c) The "advocates" for these Muslim jihadis want to release MORE Gitmo POWs into the USA. They say that "Absent the power to order the release of detainees into the United States the Supreme Court's decision in June granting them the right to challenge their confinements before independent judges 'is now meaningless.'"

4) Apart from the this despicable attempt at judicial activism, these 17 terrorists would never find immigration status in the US because "the men trained at a military camp in Afghanistan [and] they would probably be prevented from entering the United States under immigration laws."

Maybe they can temporarily bunk at the Holder residence. He seems to be in a very tolerant mood as of late.

I have said it before and I will say it again. Those judges and politicians who voted and craved this should sponsor 1 or 2 gitmo guys. They must be legally and financially responsible for everything they do for the next 18 years. I would tolerate that very much. Why not have a trio bunk with obama, same financial responsibility.

For once a court has done something sensible. I expect the aclu will rapidly come to the aid of these people and get them released among the public of the United States.

Why do we care what the Chinese do with captured Moslem terrorists? Drop them off in Western China and let them take their chances ... we don’t have to turn them over to the Chinese government, per se.

Simple solution here... Let Eric Holder take them home. I'm sure that once he visits "Club Gitmo," he'll see what sweet guys these are and take them home for dinner and to introduce them to the family. And if he doesn't have enough room for all of them to say at his place, I'm sure that Congress-critter Roda DeLaura has plenty of room at her place, now that Rahm Emmanuel has moved out...

These chinese are a special case because they had no intention of attacking the USA. So they are not enemy combatants.

But they did attend terrorist training camps, so it would be complete madness to let them into the USA. They wanted to attack China, but if they are in the USA, their ideology would be compatible with attacking us instead.

It’s a mistake to say they just attended a military training camp. They attended a terrorist training camp where muslim terrorist methods are taught and muslim terrorist ideology. No one who attends this kind of camp should ever be let into the USA.

Ummm...... yes, they are unlawful combatants. They are most certainly not a “special case”.

They were engaged in paramilitary/guerilla/insurgent/jihadi plotting and planning against China, and receiving their Muslim jihadi training in a combat zone while out of uniform and with no military insignia or hierarchy (the definition of “unlawful combatant”).

Since they were plotting and scheming against China they ought to be sent back to China for the meting of justice.

The War On Terror was never said to be a one way street.
