Right on. Can peaple real see a sitting POTUS offering up a
former POTUS to ICC. That would be treason and impeachable to do so. I just don’t see it happening. If some offence has occured we the peaple will take care of it ourself. Think of Nixon.

Thank you for adding to the debate in a constructive and informative manner. I welcomed reading everything you posted, especially the following:

This Court has also repeatedly taken the position that an Act of Congress, which must comply with the Constitution, is on a full parity with a treaty, and that, when a statute which is subsequent in time is inconsistent with a treaty, the statute to the extent of conflict renders the treaty null. It would be completely anomalous to say that a treaty need not comply with the Constitution when such an agreement can be overridden by a statute that must conform to that instrument.

The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed. The ICC is a Tribunal, the US Constitution mandates all trials must be by Jury.

As I acknowledge in an earlier post here, congressional legislation implementing the ICC treaty, were it ever to be ratified, would have to address the issues you highlighted. I believe ratification would lead to a legislative and judicial morass. I just am very grateful that, in the late 1990's the Republican congress refused to ratify the ICC treaty that Bill Clinton signed. I'm even more grateful that President Bush revoked Clinton's signature.

Nevertheless, there is NOTHING to stop Obama from re-signing it, or to stop the Senate from ratifying it if they can dig up the required votes. If and when this monstrosity is ever ratified, and if the Congress is still tilted so far to the Left at that time, the implementing legislation will be as generous as possible in favor of the international Left's point of view. Even with the inevitable constitutional challenges that would ensue, it would take years, if not generations, to undo all the damage -- if it could ever be undone.

So I would much rather people be scared of the ICC treaty enough to stop it from ever being ratified. I don't want people lulled to sleep over this thinking that it's unconstitutional, or it won't be ratified, or whatever. When has the Left ever stopped going after what it wants?

Civil Disobediance is best. Marches and Protests are a liberal waste of time.

To have Civil disobediance we neeed to have a directive to disobey from the federal government.

When we have that, then we will know what to do.

Marches and protests are a waste of time and rarely are successful. The media won’t cover them, and if the do, it will be spun as a bunch of paranoid conservative wackos.

We need to engage Obama directly on an issue.By refusing to obey a law he passes for example.

Military Officers could refuse to obey his orders until
he proves he complies with Article II , section 1 of the US Constitution.

We civilians do not have that specific cause yet, but we will.

I laud your enthusiasm, but we must be quite smart and focused on what we do, following the example of Thoreau’s Variorum on Civil Disobedience.

After that, if our homes and land are invaded by Obama thugs, we then fight them with force majeur. But not yet.Not quite yet.

But organizing for CD is a good idea, local State Chapters of Freepers could begin that.

thank you for that post.

You're welcome. I'm not a lawyer and don't have a legalistic understanding of constitutional law, but I've tried hard to acquire a solid "common man" grasp of the Constitution. The Left despises the Constitution, so we will see more and more assaults on it throughout Obama's presidency. Some how, some way, we on the right need to unify/organize to push back effectively.

Civil disobedience is a dangerous tactic to take with Communistic Democrats. They would label all such protests as a threat to the public welfare and on at least one major occasion will engage in a military response against unarmed protesters.

Stop relying on the perception that the Democratic Party cares about the Law or Morals or Right/Wrong. They most definitely do not.

Good, then let the Dem fascists accelerate conflict. There is no longer a dem party except in name only. We begin to see that now. I do not believe them to be communists, but fascists as Jonah Goldberg effectively argues in his recent well annotated history text: " Liberal Fascism" But liberal fascism works to be gentle. When they use violence in the face of civil disobediance, then force majeur can be legitimately used to answer it.Once that can is opened , we can never go back, no retreat. America is not ready for that yet, but it could be made to be. We have to take our example from the auld " Sons of Liberty" who were overwhelmingly successful. Anyone up for smuggling banned arms with the help of disloyal Coast Guard elements? LOL.

Liberal style protests and marches are a waste of time unless they involve a million people. The MSM just spins it away or ignores conservative protest. For example, millions of Americans refusing the census takers and running them off as trespassers would be a different matter, and highly effective.
