Thank you for adding to the debate in a constructive and informative manner. I welcomed reading everything you posted, especially the following:

This Court has also repeatedly taken the position that an Act of Congress, which must comply with the Constitution, is on a full parity with a treaty, and that, when a statute which is subsequent in time is inconsistent with a treaty, the statute to the extent of conflict renders the treaty null. It would be completely anomalous to say that a treaty need not comply with the Constitution when such an agreement can be overridden by a statute that must conform to that instrument.

The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed. The ICC is a Tribunal, the US Constitution mandates all trials must be by Jury.

As I acknowledge in an earlier post here, congressional legislation implementing the ICC treaty, were it ever to be ratified, would have to address the issues you highlighted. I believe ratification would lead to a legislative and judicial morass. I just am very grateful that, in the late 1990's the Republican congress refused to ratify the ICC treaty that Bill Clinton signed. I'm even more grateful that President Bush revoked Clinton's signature.

Nevertheless, there is NOTHING to stop Obama from re-signing it, or to stop the Senate from ratifying it if they can dig up the required votes. If and when this monstrosity is ever ratified, and if the Congress is still tilted so far to the Left at that time, the implementing legislation will be as generous as possible in favor of the international Left's point of view. Even with the inevitable constitutional challenges that would ensue, it would take years, if not generations, to undo all the damage -- if it could ever be undone.

So I would much rather people be scared of the ICC treaty enough to stop it from ever being ratified. I don't want people lulled to sleep over this thinking that it's unconstitutional, or it won't be ratified, or whatever. When has the Left ever stopped going after what it wants?
