16 illegals sue Arizona rancher

An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday....

"This is my land. I´m the victim here," Mr. Barnett said. "When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back."

Nethercott's previous felony conviction was in California. Nethercott's 70 acres was in AZ, close to the border.

The pistol whipping took place in Texas, on Sutton's game ranch.

The civil judgement was against all three of them, Nethercott, Jack Foote and Sutton.

Sutton paid his 100 grand judgement. Nethercott had no assets so the lawyers went after his AZ property to satisfy the civil judgement. Foote also had no assets, but he did lose his property in Abilene Texas because Texas has homestead laws that prevents the taking of a man's homestead to satisfy a civil judgement.

I'm not a lawyer, but I play one on FR.

The only thing I can think of right off the top of my head is he was already a convicted felon when he was caught with a gun. You have to be pardoned to ever get that right back. G. Gordon Liddy tried to get a Presidential Pardon so he could own guns "legally" again. Seems his wife had all the guns in the house. I always wondered what would happen to him if the feds came in and found HER guns.

As a Texan, I always wonder over other states allowing felons to vote. I don't get the advantage of allowing a murdering drug lord the right to vote again, once he's paid the "debt to society". I'd just as soon he have the right to keep a gun as vote for Obama.

I suspected this case was a load of BS from the outset, considering how Barnett was careful to turn over trespassers to authorities. Barnett is being set up as an example to ranchers and property owners who object to illegal aliens running roughshod across their properties. Now who would have the highest interest in that?

Folks, it’s time to prepare our weaponry and begin countering the opposition in the way that is always the most efficient when dealing with runaway tyranny.

You can count on it. You can also count on full-blown tax revolt if the "stimulus" bill comes to pass.

I would like to set up an internet-based legal defense fund to aid in this man’s fight. Do you have any idea how to contact him, or contact information for his attorneys?

This issue makes my blood boil, and we are going to see more and more of these ridiculous suits unless we act. My longterm goal is to start a fund that would serve as a legal defense fund to ANYONE needing assistance of this sort.

That one sounds like it is a lot more complicated a case than just some guy stopping illegals from crossing his property.

He'd have a pile o' people that would bring ol' Joe Stalin to tears if he did that...

We have as many as 3000 a night crossing the border here in Cochise County now...down from a high of 5000 just 2 short years ago.
