HR 45, gun licensing act, 1/6/09

To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes. Sponsor: Rep Rush, Bobby L. [IL-1] (introduced 1/6/2009) Cosponsors (None)

Blair Holt's Firearm Licensing and Record of Sale Act of 2009 - Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.

Prohibits: (1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions; (2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act; (3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours; (4) failing to report to the Attorney General an address change within 60 days; or (5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.

Prescribes criminal penalties for violations of firearms provisions covered by this Act.

Directs the Attorney General to: (1) establish and maintain a firearm injury information clearinghouse; (2) conduct continuing studies and investigations of firearm-related deaths and injuries; and (3) collect and maintain current production and sales figures of each licensed manufacturer.

Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

Of course not. My point is first that the foolish bravado of pitchfork-Freepers who dare the fedgov to "come and take it" would be picked off just like (or less so) than Koresh or Weaver or Gonzales. And second, the only possible way to oppose them a la some "Alamo stand" or "Lexington Green II" would be via organization above and beyond simply posting bravado under a psuedonym on a site which could be taken down (and often is!) in seconds.

The central theme being: Ain't anyone here doing anything to qualify for the latter, so stfu with the former and the "cold dead hands" bravado because it's sound and fury significant of nothing.

Instead, let's focus on what we can do, within the system, with the pathetic attention we yet have to offer, and at least delay or minimize the damage for future generations.

or me, I could see the clumsy, heavy-handed treatment and destruction of evidence (including the crime scene) by government. I asked a friend involved in that travesty to show us some proof of “illegal machine guns” that was used as part of the justification for the warrants; something, anything tangible

I recently read about a guy who was charged with owning a fully automatic assault rifle because ihs rifle had misfired, firing off three times in a row -- a defect that the manufacturer of this semi-automatic warned owners about when the barrel gets hot.

So, the Feds took the rifle and tried to replicate the misfiring. They couldn't, so they tried it a second time, then a third time, then by the fourth trial, it fired off one round, normally, then two rounds in succession, and they used that "test" as "evidence" to support the conviction.

The government already has too many ways of disarming honest citizens, and they don't need anymore.

IF taking away guns made society "polite and civil," then the government's "agencies" would not need them either.

Why do cops in San Fran, NYC, and Chicago still carry guns?

Why do EU-Cops carry guns?

Why is it that the very people who propose the abolishing of a CONSTITUTIONAL RIGHT because they so fear guns and guns in the hands of the people they are elected by and charged with the responsibility of representing in the Hallowed Halls of local, state, and federal government have their own GUN-CARRYING ARMED security details? WTH?

They want a gun ban? Then make it all-out, 100%. NO ONE has a gun. We start with the military, law enforcement, and down to John Q. Public. I mean, if no one needs a gun, then NO ONE needs a gun, Right?

After that, we go to knives. Make like Chicago--yes, Chicago--and ban anything with a blade over 2-1/2". Do it right, the way England did it. No locking blade folders of any size. Kitchen knives next, because once they took away the pocket knives the thugs just started using common kitchen knives. Safe. I want to be safe.

As for those who think the military will “save” us, I suggest you reconsider. The same psych tactics will be applied to the troops that burn the houses and shoot resisters. It will be framed as something like quarantine, of a deadly virus, terrorists, or saving the polar bears, but when the time comes a lot of people will just follow orders.

Remember last summer's gasoline outages? I watched that unfold over the course of a few weeks and the impact it had on the driving public, both those who lived in said areas and those who would have otherwise traveled through those areas but chose not to out of fear of being stranded without fuel, etc.

The southeast corner of the country was effectively shut down during that period. People just did not drive. Talk about an "Alpha Test."

There are two ways to control movement in a a free/mobile society: the first involves employing physical force and barriers; the second is simply shutting off the fuel for the vehicles. How far you going to go for how long carrying how much if you are on foot? Quarantined without a shot fired, a roll of wire strung, or positioning a superior force anywhere. Quick, easy, neat and clean.

The same principles apply to the crux of this thread. Think about it.

I read that too. There’s something quite prevalent with LEOs and that is an amazing ignorance of firearms of all varieties beyond the one they carry—and sometimes that one also. I have personally seen them unable to unload several types of semi-autos, slide-actions of both rifles and shotguns (not to mention handguns), find the safeties and know how they work and the inability to check for loaded rounds, amazing.

I have personally investigated and been part of investigations concerning “accidental discharges” of sidearms of LEOs. One Sheriff discharged his sidearm TWICE in his office during his tenure. No one was hurt but a filing cabinet and the ceiling. Another was the Chief of an International Airport police force, yet another was the discharge of a shotgun through the roof of a patrol vehicle blowing the emergency lights off (buckshot) and there were others.

Several LEOs have held up SEMI-auto AK-47s and AR-15s (which by definition is semi-auto in the first place) and proudly point out the possession of a “machine gun”. They were set right but I wonder how many folks have had to go through the “system” trying to clear himself of a false charge. Kind of like a game warden, while checking an over-and-under shotgun ask, “Is this shotgun plugged?” (migratory bird hunters will know what I’m talking about).

I mention these things which should make one wonder about their performance on other important things such as the proper handling and processing of EVIDENCE.

When I was in school, one of the classes I took was on transportation and logistics. The teacher talked about how in our over centralized society, you could shut down things very quickly with a small number of issues.

Won't go into to much details, but he used to joke 10 guys could shut down say, Chicago, in a way that would be very hard to fix. This was all pre 9-11, and I wonder if that lecture is still part of the course.

Lol, Don’t know if its true, but I heard of a gun shop owner in Long Island, fielding a question from NYPD’s licensing division which basicaly was “how many rounds does a double barrelled shotgun hold?”

It would be uncouth to truly discuss such things on FR. But the likely answers are obvious to any student of history. Also,, in theory,,, in the future, discussing such topics with strangers on chatboards like FR would be ill-advised. Capiche’?

They can declare Martial Law and more or less do whatever they want to. Katrina is a recent example of how confiscations can be done.

I seriously doubt that a majority or even a determined minority of neighbors would gang together in an attempt to stop house to house searches...at least, not during that first week or so. After than, all bets are off.

Best to be prepared well in advance for whatever possible scenario might take place. Unless you live completely off the grid, don't have taxable property, don't participate in the banking and investment industries and otherwise fly well below societal radar, they have many ways to apply pressure. Your history, reputation and character can easily be what they say it is.

There is no such thing as private property ownership in the USA. We're simply renting it from the govt with our taxes.

That's what I'm saying. Even if you own it outright and don't owe anything on it, just stop paying taxes and see how long you "own" your property. Maybe if you live on a reservation this doesn't apply, I don't know, but the rest of the country lives as the government says and most are supremely dependent upon the government and regulated systems for all aspects of their lives, for basic necessities and everything else. All but a very few are plugged in, reliant and compliant.

I agree with you and am not one of the "it can't happen here" crowd. It is happening here. The world has changed so much, so quickly in my lifetime that I fear for our Republic's future.
