Ineligible Obama, Playing with Constitutional Fire

Numerous legal challenges have been filed in an effort to force president-elect Barack Obama to validate his constitutional eligibility for the office he seeks and while it is true that suit after suit has been denied in the courts, it is also true that all of them have been denied on a technicality rather than on the merits of the case against Obama.

And although Obama could have ended the debate months ago by simply delivering a $10.00 certified copy of his official birth records to prove his constitutional edibility, he has instead chosen to spend nearly a million bucks in legal defense fees hoping to run out the clock and assume office before any of the legal challenges will be heard by the courts.

A few things are quite clear at this point

* Article II - Section I of the Constitution clearly limits those who can serve as Commander-in-Chief to "natural born citizens" of the United States, and for good reason

* The Hawaii certificate posted on Obama's web-site is insufficient and in question at best

* Obama's Kenyan relatives state that they attended his birth in Kenya

* Later, Obama was indeed a legal citizen of Indonesia, traveling under his Indonesian passport as recent as in his early twenties

* There is no known record of Obama changing his Indonesian citizenship back to American citizenship, and it wouldn't make him a "natural born citizen" even if he did

* None of this seems to matter to anyone of consequence...

On this basis, we are headed towards not one, but numerous constitutional crises.

Do you honestly believe the average American citizen or politician give a shit about what the constitution has to say? If so you have been living on a different planet than I have for over 30 years.

Well, I consider myself a modest expert on the Constitution, but only an armchair one. With that caveat ... I have to say that you’re wrong in your assessment.

The only one whose office is at risk is Obama. Biden will be certified by the Senate on Monday as the VP candidate with the most electoral votes.

Pelosi and Reid will not pay a price, except perhaps at the ballot box in 2010, and possibly from the media if it gets out that they knew. But don’t forget that Bill Clinton’s dalliances didn’t hurt the Dems, and I doubt that Obama ineligibility would hurt either Pelosi or Reid.

If exposed as ineligible, Obama would not throw the Democratic Party leaders under the bus, but no doubt there will be some upheaval there. But that doesn’t affect the government.

There is no way the election will be ruled “fraudulent” and thereby have the results thrown out. That’s why we have an electoral college and rules for choosing a President if the candidates chosen are ineligible. All we would have is a seriously wounded Presidency, either Biden’s or Obama’s, and likely GOP sweeps of the Congress in 2010.

Funny thing - it’s only people here on FR and other internet forums who are calling people kooks and crackpots. The MSM isn’t touching this at all so no one is even aware of its existence. So exactly WHO are these people calling those concerned with 0bama’s eligibility “crackpots” - people on DU and Kos? And a crew here? Anyone else tossing those words about?

Even if we decide to grandfather him as duly elected but never proven qualified by his party, for the future we must NEVER allow anyone on the presidential ballot without his/her having first been proven eligible.

Then that should apply to an Obama second term, too. If he wants to run again in 2012, show the proof.

Maybe my poor attempt at humor obscured my point. If Clinton's punishment was adequate for the crimes he was accused of then gimme some of that kind of justice.

1. obama isn’t just a regular “liberal”.

2. By subverting the Constitution, then every other part of the Constitution is now up for subverting. 0bama has already said it’s a flawed document and needs to be rearranged anyway.

If 0 is found to be ineligible and tossed, it doesn’t matter if Franken becomes President (if he was the one next in line). Constitutional requirements would have been met instead of spat on, and 0 would have the light of truth shone on his wrong doing. Or at least some of it.

Both good outcomes. Plus the Dems would have been to at least some extenet de-fanged.

At least one clearly wasn’t. Another was found during the course of the investigation to have met the age requirement for the 2008 games, but to have competed in the 2004 games when she did not meet the age requirement.

Our competitors wisely did not make an issue out of it. Our officials pushed it a bit, but then wisely accepted the results of the official investigation. The fact is, there is absolutely no way to prove the birth date of some girl who was born in China 10-20 years ago, and there’s no point pretending there is.

There is also no way to absolutely prove the circumstances of Obama’s birth. If an original birth certificate is produced that shows he was born in Hawaii as he says, we still don’t know if he’s actually the same person as the baby the certificate was issued for. Maybe his mother had another baby, and that one went to Indonesia and stayed there or died, and Obama’s parents had him assume the identity of his US citizen brother, figuring that US citizenship was a handy thing to have. There is just NO way to reach absolute certainty on this point, and there is also no clear case lase or legislation or Constitutional provision that spells out exactly what standard of proof is legally sufficient. THAT is the reason that the everybody with any power wants this issue simply tossed out by the courts. The nation cannot afford to spend years in legal haggles, involving completely new case law and probably new legislation (which would firmly close the door on the matter, as long as the SC agreed it was consistent with the Constitution), with the question of who has the power vested in POTUS through all that time.

Why are some conservatives suddenly convinced that this one issue is the do-or-die save-the-Constitution issue? What happened to confiscate-to-redistribute taxation? And eminent domain used to transfer property from one private owner to another private owner preferred by the government? And concealed carry permits required in 48 of 50 states (and not readily available to all law abiding citizens in several of those)? Why the h*$$ should I care where the President was born, when close to 50% of my income is being confiscated every year via various types of taxes, with at least half of that redistributed by government entities for things I disapprove of and don’t benefit from, and when the government is tracking my gun purchases and threatening me with arrest if I carry without a permit? Heck, if a Presidential candidate came along who’s shown he was serious about fixing those and other *huge* unConstitutional abominations, I’d eagerly vote for him (or her) even if he readily admitted he was born in Saudi Arabia to Saudi parents and still held exclusively Saudi citizenship.

Did you notice that Mark Steyn today subbing for Rush made several throaty little references to the fact that the American President-to-be is not proven eligible?? I was so happy to hear that a genius of his level felt this was absolute insanity on “our” (USA’s) part. It validated what neither Rush nor Sean nor the other Mark will.

Words mean things. Words written in the Constitution mean things. Hey, those of you who do not believe this is important, have you realized that OBAMA THINKS THIS IS IMPORTANT? If he didn’t, he wouldn’t be hiding it. He’d be out in front of his beloved prompter, telling you that the natural born clause is stupid and ancient and we are all ready for Change. (And Hope.) Obviously Obama thinks that the natural born qualification is very important indeed to America. You guys disagree with him, too. Obama’s a truther too, or he wouldn’t be fighting this hard.

Sarcasm that resonates shows the folly of a line of argument. Still, this coming congress -- the Senate especially -- is likely to be known to history as the Congress of Clowns. In November the public said, Caligua-like "Send in the clowns!".

In a way, the public is wise -- the cure is some diseases can be to hasten the sickening course, to make the tolerable intolerable in haste.

When I was a child a bunch of us kids got into constructing underground forts with connecting tunnels. A father found out and right then began collapsing the tunnels, frantically jumping on them, calling for other parents to come and see, to join in the effort. He made us help! He forced their failure. We had spend such effort making them. We were mad! Yet here we are today, alive. Not buried in some collapse when we were in them.

The US is still amazingly rich, we are not at total odds with each other, we are actually a nation of loving, caring, helpful brotherhood to a degree never found in History at this massive scale. Better we take in the clowns now and let them run the freighter intro the shoals now. We will make the shore alive and have plenty of floatsam to start again.

If this vile nexus came later in our nation's history, it might be that we would be hungry, poor, at each other's throats, cut-throat, uncaring. The boxes of floatsam would be empty, few of us would make the shore -- because we would be weak, sick, and seeking to hold down our brothers under the water -- so terrifying would the lack of resources be.

Absolutely. If we defined “natural born” perfectly, and Obama doesn’t meet the eligibility, we should only grandfather in his FIRST term. He would be ineligible to run again.

We desperately need to finalize the Constitutional definition of “natural born.” We owe it to our children and grandchildren to finally know what exactly it means.

One way to tell the 0trolls from people who are just not up to speed or have some sort of authentic reason for thinking this is not worth the trouble - people who are just not up to speed want to learn. They will read the threads, read Beckwith’s site or other like sights, they will do the homework. As we have done. And then, very often, they change their opinion about the matter.
