Judge: Birth papers to list 2 fathers

NEW ORLEANS — A same-sex couple in California has won a federal court ruling that their adopted son’s Louisiana birth certificate must bear the names of both adoptive fathers.

The facts are so clear that no trial is needed, U.S. District Judge Jay Zainey wrote.

Louisiana’s Office of Vital Records must give full faith and credit to the New York State court in which Oren Adar and Mickey Ray Smith of San Diego adopted the boy, he ruled Monday. The office had refused to issue a birth certificate listing both as the boy’s legal parents. The state could appeal the decision.

Adar and Smith said they have practical and emotional reasons for wanting both of their names on the birth certificate of the boy, identified only as “J.C. A.-S.”

IMHO the facts are not as clear in this case as the judge would have them. Lousianna should not be forced to modify their vital records for an adoption made in New York. The original birth certificate in Lousianna should stand as it is and be sealed. New York should have to issue a new birth certificate from the adoption proceedings.

Obviously, that’s not how it is, but I think that’s how it should be. If a state doesn’t have to recognize gay marriage from another state, neither should it have to recognize adoption by a gay couple from another state.

Birth certificates are primary geneological documentation. That means they can be used to find out who your actual ancestors are, which has something to do with actual inheritance (genetic and racial, if not economic and cultural.)

Altering birth certificates is a kind of fraud, as well as a way to sabotage necessary medical research.

It deprives the child of something with is essential and belongs to him and him alone: his natural identity.

As others have already pointed out, post-adoption fake birth certs issued by the State already have the names of the adoptive parents, who are frequently no relation to the child.

So if you're upset by having the names of the adoptive parents on a kid's birth certificate, instead of the real parents, write your legislators & get the practice changed.

Heck, maybe the State should issue a certificate of adoption rather than a certificate of birth. At least it'd be honest.
