Naturalization is not a vague term, it is a process that includes taking tests and culminates in taking an oath of citizenship. American CITIZENS born abroad DO NOT GO THROUGH THIS PROCESS.

There is ZERO differentiation in law between Citizens BORN ON US SOIL and CITIZENS BORN ELSEWHERE. Both are CITIZENS and both are NATURAL BORN CITIZENS. (This is where we do not agree. Both are Citizens but only those born on US soil of citizen parents are “natural born”.

We will just have to agree to disagree! :)

Philip Berg has video/audio and signed statements from Obama’s Paternal Grandmother and his 1/2 Sister, and the Pediatrician at the Mombasa Provincial Hospital in Mombasa, Kenya, that state that they were present at his birth, and the doctor delivered him. I think they also got a copy of his birth certificate from the Mombasa, Kenya authorities. Check obamacrimes.com, I believe they discussed it there.

***For purposes of his court case, he stipulates that. If you have evidence this is really what he believes, then produce it. The born-in-Hawaii cases are also weaving their way to the Supreme Court, so Donofrio may have chosen this as a tactic simply to ignore that aspect and set his case apart. It was a wise move.

I have faith that Roberts, Scalia, Thomas and Alito will make the right decision in this case.

The SCOTUS seem to know what is coming up through the circuits, so they may set Leo's case aside and await the one they feel is best suited to settling ALL the issues in one bundle. In my amateur opinion, that case would be Alan Keyes' coming up through California because Alan has absolute standing ... and he is asking all the right questions of the court as to Obama eligibility and hints of divided loyalties.

What is most troubling is the potential for an ineligible candidate to be elected by the electors then have the SCOTUS decalre he has not shown Constitutional eligibility! And if Alan's case does not get fast tracked, that is precisely what will happen before the Keyes suit makes it to SCOTUS. And of course that may be the 'out' the cowardly court is depending upon to avoid getting blamed for national riots by lawless Obamanoids.

It does not mean our case is dead. This case was brought to conference twice. Don't give up hope - I didn't look up the other case yet.

It means that they couldn't get four justices to agree to hear the case. The lower court opinion stands.

The Supreme Court is not required to hear most cases that come up on appeal. A petition for a writ of certoriari is filed which is a request to the Court to take the case under consideration. There are standards for what cases the Court will take -- i.e., constitutional question, conflicting lower court decisions, etc. But in all cases, it is discretionary with the Court as to whether to grant a writ of certoriari. Had the Court granted it, the parties would proceed to the merits by filing briefs, holding an oral argument. The Supreme Court DOES NOT take evidence, it only looks at the record from the lower court.
