Old Sarge jumped in, and set the tone, he didn’t have to. Are you his reinforcements, and transferring your attributes to me, or are those just your handy insults/ sterotypes? However his experiences have affected him, I find the words on his home page offensive. That shining his shoes part, is that a virtual reality thing, please give me an address for it. I hope his “combat fatigue gets better and he gets over being a donkey. Have a nice day and enjoy the holidays.

***That’s their job. It’s also why they’re appointed for life, so they don’t have to worry about losing their job when they uphold the constitution. But you are right: they have no desire. So the most likely outcome will be some split-the-baby decision that makes them feel like they upheld the constitution and Obama still gets to be president. My expectation is that they will instruct the Electoral College that there are truly constitutional questions about the eligibility of Obama and that this should be taken into consideration when they cast their vote, sorta like jury instructions from a judge. So when the EC votes for Obama, the Supremes can say they did their job and the EC didn’t do theirs.

I hope that your view prevails with the USSC. I would like to see the justices take this type of approach:

The United States has expended vast treasure to defend the liberties of its citizens and the citizens of other nations. That treasure, consisting of billions of dollars in monetary cost, and the priceless treasure of the lives of American Military Personnel can only be spent on the ultimate authority of the President of the United States. Thus, it was clear that the founding fathers meant that only a natural born citizen could be the President, and only a natural born citizen could ever authorize the expenditure of money and lives in the defense of liberty.

It is the duty of the USSC to correct a mistake if there was one made with reference to the eligibility of Barack Obama to serve as the POTUS. If the Secretaries of State showed gross negligence in the performance of their duties, and they did not follow proper procedures to make certain that Barack Obama was legally qualified to be nominated for the Presidency, then that is a problem the nominating party will have to correct in the future. In the present, such a mistake can not be ignored, and if Barack Obama has not by now provided legally unassailable documentation to validate his qualifications to be the President, then the electors should be instructed that they cannot legally cast a vote for him and it should be ordered that they will not do so.

I do not remember. He als did not go into great detail. It was a recent case.

Then considering Donofiro's odd analysis of the Constitution I'm betting the case in question doesn't support his position at all.

Regarding our recent conversation about the Leo Donofrio case: the following website states about the Dec 5th USSC meeting that,

“If 5 of the 9 Justices respond in affirmation (to Leo’s suit) they could grant a stay of the electoral college vote.”

I don't believe the Court has any such power. The Electoral College, during its brief existence, has certain unchecked powers and rights. It arises from an organic act of the sovereign (us) and is not subject to the jurisdiction of any Article III court, including the USSC.

The trend towards increased involvement in elections by courts is bad, and should be resisted.
