The Court could (and in my opinion, should) conclude there is presently a remedy to the O eligibility issue clearly set out in the Consitution. It is to be found in the 20th amendment provision regarding Objections to the electoral vote on Jan 8, ‘09. It is not complicated language and demonstrates the founders and ratifiers were thinking ahead and knew what they werre doing. We should be so lucky! There is no Constitutional crisis

Exactly so!

If this is not a nonjusticeable political question, nothing is.

The founders, of course, anticipated this situation and provided for it in the allocation of powers among the political branches.

Why do you suppose they put the outgoing VP, all the Senators, and all the Members of Congress in one room and made them count the votes?

Because they had nothing else to do?

Feh! If SCOTUS had refused to hear Bush v. Gore, we as a nation would be a lot better off.

Fox is going through Leo interviews? I have not heard that. Leo is a great guy and straight shooter. My guess is Obama may go down the Clinton ‘nuts & sluts” strategy or worse to attack any opponent or any citizen who asks any questions.

Scalia is refreshing like Leo. I hope Leo gets his day in court at SCOTUS along with Cort.

The archived shows are on Plains Radio now.

Ed on Plains warned me about bashing Lan. Some are saying it was a “misunderstanding.” Leo was hot last night and said if someone posts his name next to a certain picture that Leo would sue them. Lan did the same crap to Berg.

That’s right. They could do that, as long as the person meets the Constitutional requirements to hold the office. That includes Dennis Kucinich and excludes Arnold Schwarzenegger. I assume the electors are 365 Democrats and 173 Republicans.

Well I am not in favor of SCOTUS expanded powers but this case has not expanded their powers. They are the third leg the Framers designed. Legistative, Executive and Judicial. The Framers design it that way to check the power of each.

Right now you have Legislative and Executive (to be) attempting to put a most likely ineligible candidate in the White House after the Legislative (Sec of States) failed to do their job in insuring ALL the candidates were eleible to be POTUS. They never effing checked.

In this issue and with ACORN finxing elections - I have more faith in SCOTUS than our Legislative or Executive side. Leg & Exec sure as hell are not enforcing or even following the Constitution.

I did not say Fox is going through Leo Interviews. I said Fox was trying to get copies or get the use of the Leo interviews from Plains Radio but Ed Hale said they were not getting them. A little over a week ago Lan said Fox was getting nothing from him either.

I believe the media will be breaking the story this coming week. If they wait until the 5th it won’t look good that they didn’t inform the public about the Conference date until it was happening. Especially when it case has been on the docket to go before all nine Justices for Conference for over a week! Monday might be a good day to break the story with the 5th coming on Thursday! Will be interesting to see which network breaks it first.

I have no use for Fox anymore. They are just as bad as the others now. I like Hannity and Beck but they have been “sanitized.”

The entire 0 proposed adminstration is a re-hash, a re-staff, a redux, a complete weekend at Bubba’s.

We’re starting to look like a turd-world country: no new blood, just old-family snafu.

If Charlie Crist (Gov. FL) and Huckabee hadn’t colluded to kill Romney last March, it’d be Romney/Palin in office right now.

The MSM so sucessfully killed the Bush name but never had the chance to knock out Romney. Yet they’re still trashing Palin.

Well, I guess it isn’t so obvious to you, or you just want me to advocate armed insurrection. If/when I advocate such, it will not be on this forum. I do believe, however, that if a political solution is not possible, and we should slip into tyranny, that resistance (armed and otherwise) is sanctioned, and expected, by both God and the Founding Fathers. We should not go quietly into servitude, hope this clears it up.

I for one am ready for this kind of crisis. I would like it exposed that there are people in high places who are indeed willing to subvert the Constitution and our liberties to amass power unto themselves. I believe that such people are certainly running our country now. I'm ready for the fallout.

But whatever the immediate result of these lawsuits, some people of stature and standing now need to establish an organization or a mechanism that will ensure that the secretaries of state of the several states will forever in the future thoroughly investigate the qualifications of people seeking high office.

Whatever the outcome in this case, it is fairly obvious that their was gross dereliction of duty and office in the state governments with regard to ballot qualification.

Probably it would have, just as the House did impeach Clinton (and then the Senate displayed total cowardice and lack of leadership) but, nonetheless, it was one of those actual triumphs of the Rule of Law that are all too rare.

We shall see if we shall have another.

My guess is there will be one success in order to appear to be upholding the Constitution and to placate Justice Thomas and then it will be undermined by the media, judges lower down who are quite willing to prostitute themselves and the remenants of the Kennedy damage control machine. Ersatatz Republicans will assist in the undermining. It will be interesting, if there is an initial victory, to see what John McCain will say and do. Let’s see if he takes the oath he swore seriously.

Lay off the old sarge. He's seen incoming rounds and the death of comrades in several tours of duty. Most recently in Iraq.
