As a citizen of NJ, Donofrio filed in state court, an action called mandamus, eligible to any citizen who is petitioning the court to compel a state actor to do perform a ministerial function of the job. Donofrio is claiming, NJ law requires the S of S to certify the candidates for President whose names appear on the general election ballot are eligible for the job inasmuch as she has sworn an oath to uphold the Constitution. The S of S has admitted that office merely assumed BO was eligible because the Democratic Party submitted his name as their nominee. Berg is filing in federal court for Declarative Relief, that is, as merely a citizen and voter, he wants the court to declare whether BO is eligible for POTUS or, otherwise, Berg is deprived of his right to vote for someone who is.

I will not comment like others about the merits of these lawsuits, because I frankly don’t know squat about this-pro or con.
Of course, like most GOP patriots, I deep down want this to be true, and for Obama to not be eligible. One way or another though, I want it clearly settled and in accordance with the original intent of the Constitution.
IF all this turns out to be true and Obama wasn’t eligible to be POTUS based on the Constitution......then this citizen wants to see heads roll over this. I want the responsible parties (to include the “president elect”) to do HARD time for attempting to circumvent the Constitution...IF this is the case.
Well you might consider helping out. There may be people here who might be able to get word to Leo. I am not one of them.
Generally I hear the “well get em in 2010” arguement from conservatives. My impresssion is ACORN will be running our elections in 2010. Most people have no idea we had a coup with a engineered financial collapse by certain hedge fund managers, shorts and heavy pruchasers of Credit Default Swaps.
Freepers, please consider snail mailing Justices Souter and Thomas, telling them they must clear up the matter of Zero’s place of birth before inauguration day. There are many copy friendly letters on this site, that you can send in, that have all the legal details written in them already. The correct address is there for the taking too. A whole mountain of real letters sitting at the Court House steps might make someone notice. It’s worth a stamp, don’t ya think?
John, you're overstating your role in this. You did not argue this case before the Supreme Court. You've never argued any case before the Supreme Court. You've simply filed an amicus brief, along with how many other lawyers?
And, weren't you representing the ACLU at the time?
Don't count yourself too short. Lawyers hardly ever agree among themselves. The law isn't really that hard to understand once you research the case and you'll be able to argue the merits of a case. Lawyers are like weeds they are everywhere in the U.S. so it's not that hard to figure out. ;-)

Anyone who knows Emergency Relief in the Supreme Court knows that they are NEVER argued. They are ALWAYS decided on the papers.
If you had looked at the case, you would know there were NO amicus briefs in that case. There was the brief written by Don Gladden from Fort Worth and me, on behalf of Gene McCarthy, and an opposing brief by the Texas Attorney General on behalf of Governor Dolph Brisco.
And I was representing my client, Gene McCarthy.

I respectfully request that you consider reviewing Docket No. 08A407 Leo C. Donofrio, Applicant v. Nina Mitchell Wells, New Jersey Secretary of State.
Our Constitution in Article II Section 1 Paragraph 5 states “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President”.
Mr. Donofrio represents a considerable number of citizens noting the conspicuous failure of the presidential-designate to produce sufficient proof of compliance with the above constitutional requirement.
The work of Mr. Ron Polarik has shown all Certificates of Live Birth to date to have been forgeries.
Thank you for your consideration of this extremely critical matter.

Stop the Obama Constitutional Crisis
When you were first elected and as tradition requires you have sworn the oath: “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me G-d.”
Article II, Section 1 of the U.S. Constitution reads: “No Person except a natural born citizen, or a citizen of the United States at the time of the adoption of this constitution, shall be eligible to the Office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen years a resident within the United States.”
There are numerous questions as to Obama’s citizen status raising suspicion and doubt about Obama constitutional qualification to be president. To settle these questions Mr. Obama must produce proof of citizenship!
Documents that must be produced include;
(a) a certified copy of “vault” (original long version) birth certificate;
(b) certified copies of all reissued and sealed birth certificates in the names Barack Hussein Obama, Barry Soetoro, Barry Obama, Barack Dunham and Barry Dunham;
(c) a certified copy Certification of Citizenship;
(d) a certified copy Oath of Allegiance taken upon age of maturity;
(e) certified copies of admission forms for Occidental College, Columbia University and Harvard Law School; and
(f) certified copies of any court orders or legal documents changing his name from Barry Soetoro.
It is reasonable that these documents should be produced considering that his father is Kenyan, his adoptive father is Indonesian, and his grandmother claims to have been present at his birth in Kenya. If he is a natural born citizen then producing these documents should not be any problem.
These allegations will not go away until Mr. Obama produces proof to federal authorities and the public. If he will not do so voluntarily he must be compelled by every means available. You, as an employee of The People, have sworn an oath to support and defend the Constitution.
We The People are demanding you to make every effort, both public and private, to resolve this fundamental Constitutional question before 20 January.
