I am awaiting clarification from the Clerk's office at the United States Supreme Court as to whether my stay application has now been accepted in lieu of a more formal full petition for certiorari (and/or mandamus or prohibition). Such a transformation is a rare and significant emergency procedure. It was used in Bush v. Gore, a case I have relied on in my brief.
We do know the case has certainly been "DISTRIBUTED for Conference", a process usually reserved for full petitions of certiorari. Stays are usually dealt with in a different manner. As to a stay application, a single Justice may; a) deny the stay; b) grant the stay; c) refer the stay to the full Court.

Sometimes I think people like Zman DO think the Constitution is like a Chinese menu — some from column A, some from column B, etc. People do that with the Bible, too — pick out the parts they want to observe, and disregard all else.

They are very worried about Leo. The NJ supreme court changed his filing to try to sabotage his case. Why would people do this unless his case will blow someone out of the water.
We have a Secretary of State's office. We don't have a Department of State.
That even though this case is now filed correctly at the USSC and is set for conference, it will still not be decided on correctly because of how the NJ APPELLATE DIVISION has written it up?
As you can tell I am not a lawyer. So sorry if I misunderstood.
I understand as of now the SC clerk filed it correctly and is set for conference.
But the NJ Appellate Division has mucked up the process so this case will fail as of now because of sabotage?
If this is new info and not corrected as of yet, how can we Freepers help correct this?
