What is the deal with Obama's birth certificate and citizenship status?

Pamela Gellers at Atlas Shrugs raises some apparent shenanigans with the birth certificate the Obama campaign previously produced. Meanwhile, Philip J. Berg, a former Deputy AG of Pennsylvania and a professed Hillary supporter, filed a lawsuit claiming Obama is not constitutionally eligible to be president; instead of simply clearing up any questions — which you would think would take about five minutes — Obama's lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg's allegations that he is constitutionally ineligible to be president.

Admittedly, I've ignored this issue up until now on the theory that if there was anything here worth looking at, surely the Hillary and McCain campaigns would have raised it. But this all seems very strange. It's not just a matter of whether Obama was born in Hawaii — Berg claims he wasn't, but most others seem to agree he was (though the publicly available proof seems shaky at this point). There is also the question whether he was also a citizen of one or more other countries (Kenya? Indonesia?) and whether that means, as a matter of law, that he could not be a "natural born" citizen as required by the Constitution.

Has anyone around here looked into this? Is it a serious issue, and why does Obama seem to be so squirmy about it?

The fact that we have to debate and incite action here speaks very poorly for our elected representatives. Buncha gutless wonders.
Or are they just so out-of-touch that they don’t even hear this discussion? Nail their washington doors shut and send ‘em back home to listen to their constituents.

That is a rather clueless way to go about fighting one’s enemy, don’t you think?

You truly think more people or Republicans are going to vote for the ZEro just because he finally produces what appears to be an authentic BC?

And it is worth not questioning him about his elligibility because you fear the VRWC will look foolish?

He’s been given a pass on all of his transgressions and inconsistencies and you want to give him a pass on this issue too?

The FEC didn’t claim that Berg’s claims were “patently false” in their legal filing. I read the article that claimed the FEC stated this in it’s headline, but the quote was not attributed to anyone, it was not in the FEC’s legal filings. I believe this was another example of a politically motivated reporter making up a quote where none actually existed.

Suppose Obama does submit a Hawaiian birth certificate and the information on it differs from the one on Obama’s website. Wouldn’t that be an admission of fraud and a felony. Can a felon be President?

Perhaps now that Rush has commented on it today, and the National Review article came out today, some phone calls would be effective.

Let’s all call our AG’s or State Sup.of Elections and ask politely for answers! Emails are easily ignored, phone calls are not! I will be making my calls tomorrow morning!

I wonder if the attack today on a lady with McCain buttons or bumper sticker that also happened in Pennsylvania will influence the judge in any way possible?

The behavior of these “cult followers” of Nobama is getting more and more scary every day.

Just listened to Michael Savage.

I have been “tuned in” to this for some time.

The most important answer Berg gave was that proof of Hawaiian birth is NOT the end. Adoption and use of an Indonesian passport to travel, to places Americans could not go, when an adult, seems to make this all moot and at best he could have gained Naturalized citizenship and therefore NOT be president under the constitution.

The issue of father's name, mother's marriage status, and other issues all make this a "house of cards".

If indeed michelle is correctly quoted as saying "no law is going to stop him" then they are aware they can not safely cross this "minefield of legal precedents".

Berg sued Nobama, and his 5 different names-—The DNC-—and the FEC in the original lawsuit.
Berg has amended that lawsuit to add more charges, but the DNC and the FEC have facilitated this fraud to let it continue this long.

DNC should have vetted him as best I can determine.
FEC soesn’t have the policy to do that, but one would think they would be putting pressure onto the DNC.
I want a different person in all 50 states to sue the Attorney General in that state to examine the eligibility question.

He already tried that.
3 forensic document experts determined that it was a poorly tampered with copy of his half-sister Maya’s COLB, and she is 9 years younger than Hussein.

Not only that, but she was born in Jakarta, Indonesia, and she has an Hawaiian COLB. That still puzzles me.

I just can’t believe this!!! Aren’t our AG’s supposed to be representing all of us?? I for one am going to be contacting every official in my state with any authority demanding an explanation for their silence on this issue. If millions of us did this, would it matter?

There are two different docs, one is the original certificate from when he was born, the other is a certificate that you get from the state upon request that certifies that you were born. What he posted on his web site was the latter. There are questions as to whether the one he posted is genuine. He has not given anyone a physical copy of either kind of document.

Either one would probably be sufficient to constitute "prima facie" evidence in court that he was born in Hawaii. That means that absent evidence that says otherwise, it is enough. But if someone has evidence that he was born elsewhere, then you might be able to examine the genuineness of the certificates that he has provided.

Now, as to what would happen if he has previously provided a phony certificate: your guess is as good as mine. Is it a crime? Maybe. I have seen people who quote laws that say it's illegal to provide a phony government certificate for any reason. Will Dems not vote for him because of it? No. Will a court put him in jail? Not if he has already won. Will anyone even prosecute? Not bloody likely. Will a Dem Congress impeach? No.

So, pretty much the only thing to do is win the election.

Far as I know, the motion to dismiss wasn’t granted.

That would keep them on the hook and on the timetable for admissions for discovery.

The motion to dismiss was not granted. It has not been heard yet. The request to delay discovery was part of that motion. If the judge denies the motion to dismiss, he might also say that Defendant has 10 days to respond to discovery, or he might deem it admitted (unlikely) or he might grant additional time. If Berg wants the answers right now, he needs to go to court, and ask the court to compel the answers. That would normally require a separate hearing on normal notice (20 days), but he might be able to get an order shortening time and have it heard with less delay.
