October Surprise Equals Obama's Citizenship Question?
Red County ^ | 10/23/08 | Teresa Shuff Trujillo

Posted on 10/23/2008 12:32:58 PM PDT by pissant

Obama announced on Monday that he would be traveling to Hawaii to visit his gravely ill grandmother. The Obama's spent their family's summer vacation in Hawaii and by all reports the candidate's grandmother has taken a turn for the worst in the last few weeks. I sincerely wish the best for Grandma Dunham, Obama's maternal grandmother.

I was listening to Rush Limbaugh this morning as he discussed Obama's four day delay in traveling to his stricken grandmother's bedside. Rush pointed out that most of us would move heaven and earth to get to a dying relative and not delay our departure for four or five days. Maybe there is another reason that Obama needs to be in Hawaii--a reason that threatens his candidacy for President of the United States.

There is a question that the mainstream media hasn't posed to the candidate in any meaningful way or independently researched (actually there are many more). But there is only one question that would require Obama travel to Hawaii. He needs to collect his original legal birth records--records the candidate has refused to produce even when a judge has ordered their production.

When Obama made his travel announcement he knew that there would be a summary judgment against him in the Berg case the nest day. Obama's lack of response to the court is a legal affirmation that he is not a legal citizen of the United States, and as of this writing Berg has proved his case. Obama has run out of time and can no longer deflect a serious question that threatens his candidacy. Judges really do not like it when you ignore their requests.

Under Hawaiian law, birth records are sealed and can only be released to the person named on the record. This is Obama's unstated reason for an emergency trip to visit his only remaining U.S. relative--the only person who can answer whether or not Obama was born in Hawaii or Kenya. And Obama can only request the necessary documents in person--if these documents exist at all.

His Kenyan grandmother is on record as stating Barak Obama Jr. was born in Kenya.

There has been a discussion for months that the Clinton camp had an October surprise up its sleeve. Is it conceivable that the Berg v Obama lawsuit is Hillary's revenge? After all, Berg is a democrat loyalist who filed this lawsuit just four days before the start of the DNC gathering in Denver. Just because the press showed no interest in the case when it was filed doesn't mean the case was without merit and Berg has done a good job of moving the case through the court.

Hats off to Berg! He has done more to protect the constitutional question of the nominee's legal right to run for office than the Democrat Party or national press has done. If Berg is correct--and Obama's refusal to produce documents are an admission Berg is right--than the senator never had a right to hold any public office in the United States, not even Illinois state senator.

It also appears that Obama's mother waived his citizenship when the family lived in Indonesia. Did Obama's Indonesian stepfather, LoLo Satoro, adopt the young Obama?

There are a number of other questions. Let's see if Obama can start answering the court after he returns from visiting his sick grandmother.

His grandfather was best friends with Davis. That brings up the Question. Were his Mother and grandparents card carrying communists. I suspect so.

She’s coming back after the break. Jay has lots of good questions. He seldom has guests so this might get a little more traction. He has a pretty big audience.

Unfortunately, Berg’s case is probably a lost cause. I think the FEC was quite clear that he didn’t have standing, and I have to agree with their reasoning. Otherwise, we could sue the government for just about anything claiming that, as a “taxpayer”, their action affects me adversely.

I think the best hope is where, in Washington, they have appealed directly to the Secretary of State, who is responsible that only valid candidates, petitions, etc. can be put on the ballot.

In sum, even if there is a problem with BHO’s birth certificate,I don’t believe the this trip relates to that. First, no court or governing entity has yet to request for it. Second, I just got by birth certificate (from Washington State). You do not have to show up in person to get it. In fact, the best alternative is usually to [ay a third party firm to do the actual work. All you have to do is supply mother’s (entire) maiden name an father’s name, where applicable.

On the other hand, I find this Frank Davis angle to be persuasive. Obama’s father was > 80 per cent Arabic. I don’t see any Arabic characteristics in BHO’s face.

Would Rush have any legal advisers to research this to cover him before he would talk about this on his show ?

It's more that just the constitution.... there is also a immigration law that was in effect when Obama was born that made him ineligible.

As I understand it, the FEC did not state he did not have standing, but they would not join the suit. In other words they are neutral!

A guy at work today actually told me that it wouldn’t matter if Barry was born in Kenya. I said, huh? Hello? That’s unconstitutional!!! Then he said because Barry’s mother was a U.S. citizen it would make him eligible for president. What? Did I miss that day in civics class in high school? I thought you had to be a U.S. citizen, that’s why Arnold Schwarzenegger is ineligible because he was born in Austria. Can someone help me on this? Is my co-worker an idiot or am I the one that doesn’t know the Constitution?

This one is a little complicated, but let me give it a shot. Normally, one parent being a US citizen would be enough to confer US citizenship on the child, regardless of the place of birth. However, because his mother was only 18 at the time of his birth, if he was born outside of the US he would not have had US citizenship.

Between December 24, 1952 and November 13, 1986, the law specified that if you were born outside of the United States and only one of your parents was a citizen, that parent must have resided in the United States for at least 10 years, at least 5 of which were after the age of 16. So, if he was born in Kenya, he would not be a "natural born citizen", even if he later gained citizenship through other means.

The FEC has nothing to do with ballot access (placing candidates on the ballot and ensuring that they are qualified candidates.) That is purely at the state level and the political parties are supposed to make sure that their candidates meet the constitutional requirements before they nominate them. The FEC ONLY handles campaign finance issues.

If you’re born to an American citizen, you’re an American citizen. Doesn’t matter where you’re born. Your American parent is supposed to go the nearest US consul with a passport and get a certification that you’re an American citizen. Today, that’s form FS-240, “Consular Report of Birth of a Citizen of the United States of America”

He can not. Indo does not allow dual citizenship. If he was or is Indo he had to cancel US citizenship.

But he could have regained U.S. citizenship. So even with that scenario you have the question of whether folks are OK with a president who held citizenship in another country during his adult lifetime.

I think it is a dicey proposition.

He may have regained his citizenship you are correct. But let me ask you this. If so why did he not just produce the proof instead of fighting the lawsuit?
