Ohio Secretary of State Jennifer Brunner is breaking federal law by not giving county elections boards the chance to determine whether new voter registrations are fraudulent, a federal judge ruled tonight.
It is hard to imagine a public interest more compelling than safeguarding the legitimacy of the election of the president of the United States, said Judge George C. Smith of U.S. District Court in Columbus, in upholding the Ohio Republican Partys request for a court order.
Smith, appointed by President Reagan, said the Help America Vote Act requires states not only to verify the identity of newly registered voters with the state Bureau of Motor Vehicles and the federal Social Security Administration, but to provide counties with the names of new voters whose records did not match.
Brunners office had been doing the verification but had not made the names available to county elections boards. The judge gave her a week to comply.

He specifically cited questionable activity of one group that registered thousands of new Ohio voters: the Association of Community Organizations for Reform Now, or ACORN. Ohio Republican Party Deputy Chairman Kevin DeWine said the ruling spoke volumes about Brunner, a Democrat.
Her refusal to comply with federal law raises serious concerns about her ability to objectively oversee this election. It's especially troubling in light of her connection to ACORN and that group's stunning confession this week of fraudulent registration activity happening right here in Ohio, he said.

Excellent.
“...Smith, appointed by President Reagan...”
Reagan loves us even from the grave!
Elections are IMPORTANT!
This is the best darn news I’ve heard all day.
Viva La Reagan Revolucion!!
Score!
PRAISE GOD!
BLESS THAT JUDGE, LORD.
And cause all who whine about the ruling to fall in their own pit and be unable to vote themselves, please, Lord.
“...IMO, ACORN should be investigated under RICO. It sure seems to be a criminal enterprise...”
Patrick Fitzgerald is all over ACORN.
The Democrat Party should be charged under RICO
I called and left him a message of support.

Thank you Ron. You were the best.
This arrogant woman should be impeached/recalled and arrested. She's filing an immediate appeal with the 6th U.S. Circuit Courts of Appeals and said the following.
My office will do everything within its power to ensure that the states 88 county boards of elections can continue to allow early voting to proceed uninterrupted and to assist them with their preparation to ensure a smooth election for the voters of Ohio.
It’s time for their legislative body to modify the Law.
I think you could, but I think you can't.
Yep, the dam is finally breaking.
Thank you Judge.
How can she get away with this? I guess that’s rhetorical.
Agree.
Perhaps you haven't seen that Fitzmas is coming early this year .
If the Sixth Circuit reverses or vacates this decision, it will go to the Supreme Court. McCain v. Obama anyone?
If obama is president in 2010 perhaps his approval rating will be about as low as Bush’s now. That should mean Brunner and Dems around the country will get tossed out.
And that is why I volunteered to be a poll watcher! I haven’t heard back yet, but man do I want to do it. Even already requested the day off! Every presiding judge in my voting block is a democrat! Our BOE for Cuyahoga website has it set up so it can be researched!
Our news channels in Oklahoma are reporting that Fitzgerald the special prosecutor from IL who had been investigating ACORN and handled the Retzko trial is now handling ACORN under RICO statutes. The first news report said 10 states, 2nd news report said 14 states, and the last one tonight said 21 states are being investigated.
