Contrary to Internet Rumor, No Court Ruling Yet On Obama / DNC Motion to Dismiss in Berg v. Obama

I received a phone call from Phil J. Berg a few minutes ago. He informed me that a rumor is circulating on the Internet that the Court has ruled on the Motion to Dismiss filed by Senator Obama and the Democratic National Committee in the Berg v. Obama case. Some of the visitors to this website have posted comments claiming the Court has ruled. The comments on this site were written by visitors to the site.

On Mr. Berg's behalf, I am posting this to state clearly the Court has not yet ruled on the Motion to Dismiss in Berg v. Obama.

Here's the status:

1. Last week Senator Obama and the Democratic National Committee filed a Motion to Dismiss the Berg v. Obama lawsuit. 2. On Monday, Mr. Berg filed an answer requesting that the suit not be dismissed and that the Court order production of documents proving Senator Obama's consitutional qualifications to serve as President of The United States. 3. As of 1 AM EST today, October 2nd, 2008, the Court has not ruled on the Motion for Dismissal in Berg v. Obama.

I was speaking with a friend about the election, pro McCain, and he did not know about this because not everyone uses the Internet like we do.

So where are the 527’s on this issue and others. They must be starting soon. I cannot believe no one is coming to McCain-Palin’s aid with all the bull that is on Obama.

The election goes forward and if he cannot prove he is eligible to take the office, then the VP takes the office.

Here is my question. If you don't have to prove you are eligible to 'run' for the Presidency...then what happens (hypothetically) if 0bama wins and is found not be eligible? Does Biden take office? Does it require an impeachment (ie, high crime or misdemeanor)? Why is this being so dismissed if his elegibility cannot proven now? What would would/could be done after the election?

Voters have the right to know at the time they cast their ballot that their candidate is eligible for office under the requirements of the Constitution. I do not understand why the FEC is not actively investigating the qualifications of ALL the candidates---including OBAMA. They should be the clearing house to insure that the eligibility requirement has been met. By the way, I did send a message to the FEC to express this concern.

No they do not.

The Constitution does not prohibit anyone from running for president merely because they are not qualified. The constitution merely prohibits someone who is not qualified from taking the office.

The Voters have no rights to any information regarding a candidate. They do not have a "right" to know his age, his birthplace, his sex, his height, his weight or his criminal record.

There is enough that we do know about him that is incriminating and should disqualify him from any public office. What don't we know???? Where are the private investigators?
