Palin's husband refuses to testify in probe

ANCHORAGE, Alaska (AP) — Alaska Gov. Sarah Palin's husband has refused to testify in the investigation of his wife's alleged abuse of power, and a key lawmaker said Thursday that uncooperative witnesses are effectively sidetracking the probe until after Election Day.

Todd Palin, who participates in state business in person or by e-mail, was among 13 people subpoenaed by the Alaska Legislature. McCain-Palin presidential campaign spokesman Ed O'Callaghan announced Thursday that Todd Palin would not appear, because he no longer believes the Legislature's investigation is legitimate.

The state legislature Obama Democrats are attempting to hijack this for political purposes. The State Personnel Board has the responsibility for the investigation, which is a red herring. There is no “there” there and everyone knows it. They should be investigating the wiretap and theft of personal emails.

Yes, in the US a spouse cannot be compelled to testify against the other.

The spousal or marital privilege has a long history, though its application has evolved over time. The law holds that no one has a privilege to refuse to testify unless otherwise provided by constitution (e.g., the right to avoid self-incrimination), statute, or state or federal rules of evidence. The spousal privilege is a combination of two elements: 1) the right not to be compelled to testify against one’s spouse, and 2) the protection of marital confidences.

So basically, they are making a big deal out of something that most of them would do if in the same situation. Sad thing is, there are a bunch of folks who will look at this as some sort of conspiracy to hide evidence.

Seems to me this is opinion stated as fact. No examples are given, just this statement. More fact-free content from AP.
