Atlantic Magazine Might Sue McCain Smearing Photographer

The photographer that viciously smeared John McCain at her website might be facing a lawsuit for violating the terms of agreement in her contract with The Atlantic magazine.

As NewsBusters reported Saturday, Jill Greenberg not only admitted to taking a rather sinister picture of the Republican presidential candidate that she hoped The Atlantic would use on its October cover, but she also generated some truly disturbing and disgraceful images of McCain which she proudly displayed at her website.

The magazine's editor, James Bennet, told Fox News's Megyn Kelly Monday that he was deeply sorry about this incident, and that The Atlantic isn't taking it lying down (audio available here, partial transcript follows, h/t NBer blonde) :

JAMES BENNET, EDITOR 'THE ATLANTIC': I'm already drafting a letter of apology [to McCain]. I mean, this photographer went in there under our auspices to take a covershot for us. Again, we stand by the picture, and we produced a terrific story on John McCain...But while she was there, she behaved in an incredibly underhanded and unprofessional way. [...]

MEGYN KELLY, HOST: What do you do to shut down her use on her website, not just of that covershot, but the disgusting things she has done to John McCain's image on her website which I won't repeat here?

BENNET: She's violated the terms of our agreement with her, or our contract with her. So, we're taking steps. We're looking into steps we can see to do something about that.

KELLY: Are you considering a lawsuit?

BENNET: We're looking into what we can do.

KELLY: Would that be including legal action?

BENNET: If we can, if it's available to us, yeah.

KELLY: Has she been paid?

BENNET: No.

KELLY: Will she be?

BENNET: No.

Clearly, this story isn't over yet...not by a longshot.

They should turn off every American. I don't care what your views are, no professional photog would do that to his subject.

Oh, yeah. The Atlantic will sue some borderline-psychotic artiste photographer who should be in a home somewhere. That'll happen.

I have no problem with average Joes (and Jills) touching up photos for a cheap laugh. Hey, we do that here all the time. But when a professional photographer does it while on an assignment, that is a different issue. This photographer should be hanged, drawn and quartered! (Well, maybe that is a bit harsh.)

Ok, the photographer has a severe case of Republican Derangement Syndrome, what about the editor of the magazine? Isn't there equal culpability here? Fire both dolts then sue their butts.

Personal feelings aside, The Atlantic cannot afford NOT to chastise this “artiste”. She was on THEIR dime taking pictures for THEIR story. You can imagine the possible consequences on getting future interviews if their interviewees are trashed like that.

For those who don’t know, check out Michelle Malkin’s site.
This “photographer” is the same one who brought in several children, asked the parents to leave the room, then terrorized the unsuspecting children so she could get shots of crying kids in her anti-Bush “statements”.

Read Michelle’s article. It will make you mad.

Just one more example of how demented a liberal can get. It is, indeed, a mental illness. Sadly, this sort of thing almost always starts on the liberal side and then when the conservatives try to respond or defend themselves it's reported that ‘everyone’ is doing it.

It's like they've given up on winning the election and are determined to use their old standard fall back of scorched earth policy.

I hate to say it, but the Bush administration hasn't help one bit with their reluctance to fight back the last six plus years. IMHO, their first error was in not cleaning house at State and CIA, but then they compounded that by seriously mishandling things like Scooter Libby's case.

I guess when it comes down to the nitty gritty you're either a fighter or you're not. I don't think there's any question about which category John McCain is in! And even more importantly there are differing kinds of fighters. Obama is the type that whines and snipes and runs his mouth. John McCain, OTOH, goes for the kick ass and take names approach. I think the latter is much more suited to the threats facing 21st Century America!

No way. Even though they are liberal they got burned by this sick puppy. At least they didn’t pay her though I think this notoriety is helping her bottom line in the future

I saw a lot of her other “art” and it is dumb and ugly

Isn’t it grand that the Left loves to bemoan the Right’s supposed “lack of civility”—yet they prove how uncivil they are every chance they get. Mostly on blogs, but now this. McCain should sue the Atlantic and make an example of them—they probably created an environment where Ms Greeberg thought such antics were acceptable. She will be no doubt be sued, but I’m sure her Lefty friends will bail her out and she will be the toast of cocktail parties.

True. They may also have learned something from the USWeekly disaster, which is: don't try to defend this cr*p; just go out and apologize for it before thousands of Americans call your advertisers who, in turn, can and will make your life a living hell.
