Some concerns I have
[1] Use of data "September 31" may invalidate this motion.
[2] Berg is a Democrat. Should Republicans rely on him or file their own suits?
[3] Was this planned all along so DNC could pick a "special" candidate without requiring primaries and without examination by the press that he/she could not survive?

berg makes some persuasive arguments. i don’t think the “sept. 31” mistake will be a problem.

Berg is a Democrat.. Was this planned all along so DNC could pick a "special" candidate without requiring primaries and without examination by the press that he/she could not survive? I didn't know Mr. Berg was a Democrat? Is he a "Joe Lieberman" or "Zell Miller" Democrat? (In which case his motion will be summarily dismissed, at least by our "free" press.) If he's a "for real", full-tilt establishment Democrat, your theory may be hold water. Could this be the fabled "bombshell" the Clinton's threatened to drop, but may have decided against dropping to avoid looking "racist and xenophobic"?

Berg is a Democrat. Should Republicans rely on him or file their own suits? Leave it to the Democrats. The GOP should not get involved in this.

Good points. Democrat perfidy has sunk to such levels that I wouldn’t put it past them.
