Yeah it will. A judge cannot issue a order to comply by a fictitious date. It'll get thrown out and they'll have to refile. It may push things back a bit. Obama may have to be deposed no later than October 32nd.

Berg was submitted the information by the people who were writing on FreeRepublic last spring.

At that time we didn’t know who the democratic nominee was going to be - therefore he wasn’t necessarily fighting the “candidate” of the Democratic Party until after he
had received the information which was also made available to us on FreeRepublic.
