Federal officials try to block Texas execution to allow review of case

Fourteen years and numerous judicial reviews have passed since José Medellin was sentenced to die after confessing to the brutal gang rape and murder of two teenage girls in Houston.

JOSÉ MEDELLIN That's long enough, state officials say. It's time to carry out the sentence.

But defense attorneys, and an unusual coalition of federal officials, including no less than the attorney general and secretary of state, say if his Aug. 5 execution is not stayed, so Mr. Medellin's case can be reviewed one more time at the behest of the International Court of Justice, Texas will be rushing to judgment and endangering Americans abroad.

Let’s see - fourteen years, several reviews and he’s still alive. On the other hand an innocent baby can be legally killed in less than eight months.
I guess that seems rational.

a bill was introduced in Congress by Reps. Howard Berman, D-California, and Zoe Lofgren, D-California, to require states to come into compliance with the International Court order

the United States as a whole is obligated to abide by international treaty obligations, but individual states are not.

José Medellin, 33, was convicted of the 1993 rape and murder of Elizabeth Pena, 16, in Houston as she walked home. A friend, Jennifer Ertman, 14, also was killed.

Mr. Medellin was born in Mexico but had been in the U.S. since early childhood.

His case has since gained notoriety as Mexico sued the United states in the International Court of Justice on behalf of 51 Mexican nationals asserting that, in these cases, the US had violated the Vienna Convention on Consular Relations, to which it is signatory, which requires that local authorities inform foreign nationals being held on criminal charges of the right to consult with their country’s diplomats. That court ruled that the United States was obliged to have the defendants’ cases reopened and reconsidered. The Supreme Court of the United States agreed to hear the case on May 1, 2007.

On March 25, 2008, the US Supreme Court rejected the Bush administration’s arguments and cleared the way for Texas to execute his sentence.

On July 16, 2008, the International Court of Justice overturned the ruling by the US Supreme Court and asked for a stay of execution on Medellin and four other Mexican Nationals who also did not receive a fair trial.

Oh really?!

Which has much jurisdiction and standing in the case as the International House of Pancakes.

There is no new information. No new evidence. No new arguments.

The case has made its way through the appeals process, and he has exhausted all his appeals.

The Texas courts have already looked at the issue of if he was properly notified of his right to contact the Mexican consulate. His appeal due to that issue has been denied, and there is no new argument for reversing that denial.

The time for carrying out the sentence has not only come, but is overdue. Texas should rightly tell idiots among the Bush administration to mind their own business and stay out of it, and carry out the sentence.

So Americans will be “safe” in Mexico and other Third World Hellholes if we refrain from meting out just punishment to Mexican murderers and rapists here in the USA. This would be laughable,if not so tragic and pathetic.

Medellin in his own words:

“My name is Jose Medellin, I am currently being held on Death Row, in the State that is at the top of the list for Death Row population, 453, executions this year: 26, as of 9/14/99. The State and government that also executes its children, its retarded, its poor. This state is the Lone Star State of Texas!

“I am a Mexican national. I came to Texas as a young boy along with the rest of my family. Not like many that are not proud of their country and want to get away. But just took a chance and opportunity at a brighter future. I am a Mexican through and through!…

“I dropped out of school in the 9th grade, not because I couldn’t handle the work, because if you give me the time of day, you’ll see that I’ve quite intelligent.

“I had a plan, get my GED and go home to join the Mexican military, would have joined here, but I’m a Mexican, not a traitor :- ) I had everything in order, but as I said, the world takes twists and turns when it gets ready to, no matter if you are ready for the move.

“Don’t feel sorry for me. I’m where I’m at because I made an adolescent choice. That’s it!

“Then after that I’ll be willing to tell you who the boy was that got himself arrested for capital murder. That way you can have a clear understanding of how far I have come.”

Here’s what Medellin did:

“On the evening of June 24, 1993, Jennifer Ertman, 14, and Elizabeth Pena, 16, left a social gathering at a friend’s apartment in Houston. They were taking a shortcut home through the woods, when they encountered Jose Medellin and other members of the so-called ‘Black and White’ gang. All six gang members were engaged in a gang initiation rite for Raul Villareal. The gang had spent the evening drinking and “jumping in” Villareal, requiring him to fight all the other members until he lost consciousness.

After stumbling across the Black and White gang, each girl was repeatedly raped by the gang for the next hour. The girls were then strangled, beaten, and kicked to death.

The idiot defense attorney says “a deal is a deal”, referring to the treaty. That’s right buddy, a deal is a deal, and the relevant “deal” in this case is the Constitution of the United States, NOT some treaty that the Federal Government never had the authority to negotiate in the first place! Sheesh!

Not sure if the President can issue a pardon for a state crime. If he does, that will seal the election for Obama.

Personally, I hope the guy trips and falls into a wood chipper.

When I am not reading or listening to the radio I like to work out. I do this to stay in shape and also to keep the blood and mind flowing. Since we are limited on our activities through 23 hours of confinement the inactivity will either kill you or drive you insane until death is the only liberator.

Jose Medellin confessed in 1993 to participating in the rape and murder of two Houston teenagers. Jennifer Ertman and Elizabeth Pena were sodomized and strangled with their shoe laces. Medellin bragged about keeping one girl's Mickey Mouse watch as a souvenir of the crime.
