Top 10 Things to Expect From Obama Court

The conservative-leaning Committee for Justice is trying to rile supporters with a “Top 10” list of things to expect from the Supreme Court should Barack Obama be elected president and appoint his desired justices.

CJ Executive Director Curt Levey wrote supporters an email Monday with the words “Obama court is a conservative nightmare” in the subject line.

“That very real possibility should frighten conservatives all the more when they consider that 1) by the end of an 8-year Obama presidency, Justices Scalia and Kennedy would be 80 years old, an age most men never reach, and 2) given the damage the Supreme Court has done to the rule of law since 1969, imagine what the Court would do if it regained a “solid liberal majority,” Levey said.

The Supreme Court is currently narrowly divided along party lines. Nearly a third of all Supreme Court decisions are decided 5-4. Any Obama-appointed justice would likely give the court a liberal preference. Given Obama’s stances on various issues, CJ compiled this list with what their group believes Obama’s appointed justices would be capable of doing:

10. Expanding and perpetuating the use of racial preferences

9. Creating new constitutional rights to physician-assisted suicide and human cloning

8. Expanding judicial oversight of military detentions and CIA interrogations

7. Prohibiting tuition vouchers for religious schools

6. Banning the death penalty.

5. Requiring taxpayers to fund essentially unlimited abortion rights

4. Creating new constitutional rights to massive government welfare and medical care programs

3. Stripping "under God" from the Pledge of Allegiance

2. Eroding property rights

1. Ordering all 50 states to bless gay marriage

Missed the biggest one: Make the judicial system into a partisan branch of government by appointing Hillary and others of her ilk to the Court.

If he does pick romney for veep he will lose in a landslide.

He already has the rockyfeller vote, but that pick would cost dearly in the remaining 2/3 of the base.

What a sad day! That comment should give me a belly laugh, it is exactly the sort of dry political satire that I have always loved. Unfortunately, in the context of the current campaign it only seems like a statement of the obvious.

I would like to add one more that was missed. Given Odumbo’s comment, “I’m a citizen of the world”....

Expect our national sovereignty to be handed over to the UN. Expect also some constitutional change that allows citizens of other nations to begin voting in American elections.

Catch that you anti-McCainiacs??? Your actions in November may well END America as we know it. We’ve always heard vote for the lesser of 2 evils....this year it REALLY IS the lesser of 2 evils.

I do not know if I’m more frightened of Odumbo himself, the ‘americans’ who are seriously entertaining the idea of voting for this marxist anti-american, or the ‘conservatives’ who will not vote for McCain on the matter of ‘principle’ and by so doing put Odumbo into the oval office!!!!!!!!!

here we go again, fearmongering BUt,bUTT, pawpaw will nominate conservative judges!!!!
I see no evidence of that. We really need to find a way to work around SCOTUS so we are not selecting candidates based on the assumption of who they will pick. In a few years it will be a moot point finding a conservative judge to nominate.

McCain is still very much a wildcard on this. I mean suddenly we are supposed to trust a known RINO because he told what he’s going to do something.

The guy did vote for both Ginsburg and Souter and had no qualms in doing so.

Right on. At first I was going to stay home or vote third party if McCain got the nomination. Then I saw this OBama surge come along and I spent a lot of time in prayer and meditation and it revealed to me that voting for McCain is the right thing to do. I know we might not get the whole loaf with McCain, but we will get half a loaf or maybe even 3/4ths of one. With Obama, we won't get a loaf at all and he'd take the crumbs to boot. Plus the Supreme Court, maybe McCain's appointments might not be 100% perfect but they will be helluva better than Obama's. Thinking about that, if Obama get's in, America could be finished totally. I really believe that, not only over the Supreme Court but with him soft on terrorism, you could see mushroom clouds above our cities or a similar scenario. I guess the daying is true, "cutting one's nose off to spite their face." Incredible times we live in.

somehow I don’t buy that Romney equals loss. Think there are far better choices (NOT huckabee) such as the former senator of Pennsylvania but we have too many country club republicans like mccain who really don’t give a rat’s posterior about conservative issues and would have no objection to any of the ten on the list.

You know, there is a critical point here all of the hard core conservatives here on FR actually know about, but in knowing, they somehow dismiss it.

Simply, there is no value in having a conservative agenda loudly spoken and advocated in the 2008 election. That would be explicitly contrary to the conservative cause.

Why? Because there is essentially 0 chance of a GOP Congress next year. Therefore the absolute most important thing is winning the White House in order to dilute and weaken the Congressional agenda. You win the White House with the middle. Not the far right.

Romney has an array of left wing acts in his history that when combined with his more recent conservative positions paints him as a centrist. McCain has always seemed like a centrist to the public.

It doesn’t really matter that neither is a hard core conservative because a hard core conservative isn’t going to get anything done if he wins, anyway. Therefore, the optimal strategy is minimizing risk of an Obama win, and you do that in the middle.
