We're dealing with separate cultures and systems of laws.....separated by centuries. We're coming to a breaking point in the UCMJ and the treatment of those captured on the battlefield. It is quickly becoming a liability to take them alive.

We did gain intel....the hard way. The detainees want to lawyer up, the courts want to grant them rights and the Dems want to allow them access to the US. More US troops have faced a Courts Martial than any of the combatants. The sensible solution is to send them back to the point of capture and let the locals there dispense justice.

Frankly I prefer “mopping up” out in the field so you don’t lug around any foreign baggage. But giving them back to Afghnistan or countries of origin would be preferred. Much preferred to having revisionist Judges decide that how we’ve dealt with illegal combatants (non-uniformed and caught on the field of battle or in the act of sabotage/spying) for the past 230 years is a violation of their civil rights.
I want to shut down the opportunities these revisionist Judges are using to subvert our Constitution.

Here's the problem, one that has occurred previously. The combatants are multi-national mercenaries. If mercs are returned to their countries of origin, nothing happens to them. They're released. Turning them over to Afghanistan also creates a locally political problem if the national Afghani government can't control jurisdiction in the capture areas and just shoot ‘em on Friday night.
No Quarter works but only if the press isn't present.
