WHY did the Founders bother toiling in the summer heat of Philadelphia in 1787 writing a Constitution when they could have relied on the consciences of Supreme Court justices like Anthony Kennedy instead?
Kennedy is the court's most important swing vote and its worst justice. Whatever else you think of them, a Justice Antonin Scalia or Ruth Bader Ginsburg has a consistent judicial philosophy - while Kennedy expects the nation to bend to his moral whimsy. With apologies to Louis XIV, Kennedy might as well declare la constitution, c'est moi!

Stevens is the worst. Kennedy is the most schizophrenically embarrassing.
What the hell does the man stand for? He’s all over the map. At least you always know how a Ginsburg will vote.
A clown? Yes...a clown. In a role that requires no clowns. As to being the worst...I’d put RBG ahead of him for that distinction, IMO.

I think he must choose like I did when I took business law. In the cases I studied I wanted to see a party win because it was the “right thing” but unfortunately that party was on the wrong side of the law.
When Hamilton backed up the Continental currency, our word meant something. Now, we have no uniform standard of law, it is at the whimsey of a court that has no conviction to the Constitution.
Where would you rank Ginsburg and Souter? Or can't they be the worst because they are more incompetent than wrong-minded (Ginsburg is both)?
I have had this discussion before, only about which state has the worst U.S. Senators. My two, Durbin and Osama will give any other two a run for the money and they are contending with the likes of Schumer/Clinton, Kennedy/Kerry.

Senators? I’ll stack my two against yours (Kennedy/Kerry). Kennedy’s done a lot of long term damage, over several decades. I’ll grant you, though, that Obama’s got potential and a base to build on!
If by worst - you mean mean & evil, maybe Illinois wins (er ....looses), but if by worst you mean STUPID - then I think Washington State, with Patty Murray and Maria Cantwell win HANDS DOWN!!!
I have a real problem with people who attack Kennedy while giving a pass to Stevens and Souter - to say nothing of Ginsburg and Breyer, who at least were named by Clinton and therefore have an excuse of sorts.At least Kennedy is right as often as the Court as a whole is right. The others I mention would have to vastly improve to be as accurate as a stopped clock.
Likewise, I have a real problem when people want to attack the oil companies for the high price of gas - yet the gas stations are, obviously, the place where the price of gas is the lowest - you try to buy gas anywhere else, they'll just go to the gas station for the gas, and charge you for the trouble.
Stevens respects the 4th Amendment.
At least Stevens and the crew are consistent. The only thing you will find in the middle of the road is Justice Kennedy and road kill, and both are equally worthy of our respect.

And if we still had the majority in the House and ...Tom Delay, we could do something about this horse's ass and other Fed Judges who make up the law as they go along.
oops, my bad I forgot. Tom Delay did once mention looking into doing something about these 'gods in Black', i.e.: Impeachment, and got b*tch-sl*pped by almost everyone for 'threatening them and their independence'. Creating an 'atmosphere of fear' or some similar nonsense and putting all the Judges lives in danger.
Of course we'd still need the senate to find them guilty and kick them out, but that ain't my fault either - I voted for Alan Keyes (thanks IL GOP, ya boneheaded criminals).
btw, When the heck is Tom Delay going to trial for all his (cough) crimes? Sometime this decade I presume.
Kennedy is a huge admirer of O'Connor. When she left, he all but promised to replace her.
What actually happened on Scotus is O'Connor resigned, Kennedy replaced her and Roberts replaced Kennedy leaving the place status quo. In a way, O'Connor never left.
